What is expected of me when I go in?
answered on Jan 8, 2020
More than likely you will need to bring in your registration of your vehicle to show the vehicle is properly registered. The court will require you to show that to the officer and could dismiss your charges. They could also dismiss it as having complied with the law which may require you to only... View More
80 in 70. Got ticket and another paper marking how much 6.00 every mile over. But I dont have the option to pay this. Should I go to courthouse in person?
answered on Jan 3, 2020
You more than likely have been charged with Reckless Driving which is a class one misdemeanor that can end up with jail time of up to a year. 80 miles per hour is reckless driving not speeding. That is probably why there is no online payment option. You will need to appear in court. I would... View More

And recently got a ticket for failure to update Licence while I had a short stay with family in VA. I was just in US for less than 3 weeks .

You are required to update your license within 60 days of moving to Virginia. If you plan on remaining in Virginia you should obtain a Virginia license. If not, then you should get an updated license from your new state of residence.
I may or may not be able to appear on the court date and have retained an attorney. But want to know the consequences of the attorney does not show up on the court date for any reason.

Your lawyer should advise you if you need to appear in court or not. Since courts require your presence even with a lawyer. Get it in writing from your lawyer on whether you need to appear or not.
I recieved a speeding ticket today for doing 76 in a 60. Officer left case number blank and made me sign the white copy after he already ripped the carbon copy off and gave it to me; so neither copy had a case number and my copy doesnt have a signature. Is this cause for dismissal?

Maryland driver here. Got pulled over in Marion VA for reckless driving going 102 in 70 for about 5 seconds trying to get around a cluster of slow drivers (they were going about 55-60). Clean record otherwise though theres some speeding tickets from cams on my vehicle. Wondering about the chances... View More

Every court is different at that speed. Talk to a traffic lawyer in the location you got the ticket. Where I practice some judges give you the chance to do 100 hours of community service to stay out of jail and avoid a license suspension. Other judges you are going to jail for 1-30 days no matter... I got a speeding ticket 5 months ago and the judge said if I didn't get another one, did a driving class, and did community service, the charges would be dropped. I just got another ticket before the 6 months are up.
answered on Nov 12, 2019
Unfortunately, since the judge cut you a break, its likely you will be found guilty on the original ticket and perhaps the new one. I would take your tickets to a lawyer and get some advice from someone who is local to you and has more insight on the particular judges. Lots of lawyers do free... View More
I am a tourist visiting the US and got an 80/70 ticket in the hire car. The officer misread my papers and issued the summons entering my middle name as my surname, my real surname not appearing at all.

It depends on your age and prior driving record. If you're licensed in Virginia and 20 or older it doesn't sound like it would get suspended. The court can suspend if it's reckless driving by speed though.

It will truly depend on the jurisdiction in which you were charged. There are many judges in Virginia that will impose a jail sentence for driving at that speed. You will want to contact a local attorney right away.
I have no mufflers or catalytic converters on my truck, but my vehicle is registered in Colorado.
answered on May 3, 2019
You are required to adhere to the requirements in the state the vehicle is in, even if you are driving through. So people from Florida get tickets all the time for window tint that is legal in Florida but not legal in Virginia even though they are just passing through.
My GPS had me taking an exit on the left and I thought I was crossing over the HOV lane to get off of the highway, this is my 2nd offense so I avoid HOV lanes, but once I got off on the exit(which apparently was also an HOV lane) there was a police officer at the end of the exit which was about 500... Will this be thrown out since dmv was notified I just didn't get a new card. If I'm reading right notifying them is all i had to do, getting a new card wasn't required.

If they charged you with 46.2-324 then I think you are correct. If you can show you notified DMV it should get dismissed.
