Q: My child’s father hasn’t paid child support this year and has missed multiple payments prior.

It’s supposed to come out of his paycheck, but I’m assuming he quit or was fired. Can I just file something online or do we have to go back to court?

Go to The Dept of Human Resources in your county and ask them to collect it for you it’s based upon income so they most it will cost you to file is $25. Good luck.

Q: My daughter is 18 and has moved out of the house with my ex-wife. Do I have to pay support for her still?

My daughter is now living with her boyfriend and has become "self-sufficient" as defined in our divorce agreement. Can I refuse payment or do I need a court order to modify?

Q: I was incarcerated 24 years. I have been released two years. Learned I am in arrears $100,000 for adult child.

My take home pay is $300 wk. Do I qualify for a modification?

If the child is an adult you cannot modify past due support unfortunately.

Q: How do I extend child support payments or ensure assistance with my 18 year old daughter's college expenses?

There is currently a child support order in place, and all terms are being met. My daughter be 19 in seven months (March 2021), & unless I take action, her financial support from her father will cease.

Unless she is disabled, there is no way to extend child support past her becoming a legal adult at 19.

Q: Will support go down if child’s father has baby on the way. Baby won’t be here until next year and court is sept 21 2020

He has had a dramatic increase in wages so that’s why I went back to court. But now he got his wife pregnant in hopes to lower support being paid.

Q: ARJA Rule 32. Alabama. My child will be 19, graduated, will I have to put a change order with court for child support?

My child will be 19 soon, refused to go to college and attending trade school. Will the court enforce my child support order beyond the age of majority? Will I need to initiate a change order? Or does it end automatically?

None. If child support was ordered and he didn’t pay it, he owes it to her. There is nothing he can do.

No. It’s not based upon who makes the most. It’s based upon yours and his combined income and a percentage of the amount of child support proportionate each of your incomes. Probably not. He still has to come into court and be adjudicated the legal father. At this point he can ask for a paternity test and if it shows he’s not the father then he will not be liable for child support. Hello. He doesn't have to be in their life, but if he is found to be the biological father (proved via official DNA testing), then he'll be paying child support for the next 19 years.

It must stop at the childs 19th birthday. However if college expenses were reserved in the divorce decree then you can file for a modification prior to the child turning 19, in order to ask the court to extend the child support as college expenses. Yes. You can go back to court and change custody so you can stop paying her.

Q: Doed back child support start the first day you got custody or the first day you filled the petition for child support?

My sister has had full custody of my children for 3 years. But she just recently filled for child support about a year ago. Will the back child support go back to the day she got my kids 3 years ago or does it go back to the day she filled the petition for child support 1 year ago?
