Q: If insurance allotted $12,500 to fix my damaged car & it only cost $4,000 to repair, can my bank keep the excess money?

This is in the state of Arkansas. The bank I have my car loan through took the excess money ($8500) my car insurance company gave me and applied it to my remaining car loan balance. Is that legal?

Q: If a pedestrian fails to yield or give motorist right of way,refused to press charges, what are motorist rights?

Pedestrian ran out in front of motorist and almost jumped over car, but landed on windshield on passenger side, minor injuries, but wants motorist to pay, incident happened almost 2wk ago but no report was made

One option is for motorist to report it to insurance and let them handle. A local lawyer can advise.

No, they should still have to prove fault if you injured someone or their car was damaged. However, most states require auto liability insurance and you may be charged for a case in court on that basis. Consult an attorney where the accident happened ASAP.
