Talk to a member of the Tennessee Assn for Justice --they give free consults. Discuss with him if you have uninusured motorist. Run the damage part through your own collision.
I was airlicted to Wadley hospital.knocked unconcious,I have 12 staples to the back of my head,bleeding on the brain,a severe cocusion,heart rate at 204 from pain and shock. The vehicle is totalled.started to try to catch fire untill my step dad removed my unconcious body and unplugged the battery.

This is in the state of Arkansas. The bank I have my car loan through took the excess money ($8500) my car insurance company gave me and applied it to my remaining car loan balance. Is that legal?

No, they should still have to prove fault if you injured someone or their car was damaged. However, most states require auto liability insurance and you may be charged for a case in court on that basis. Consult an attorney where the accident happened ASAP.
