It has been almost 2 years since the accident that the other party's insurance agreed their client was at fault. First, set up an appointment for a face to face with him. Part of the problem may be that you finished treatment, the insurance is playing a waiting game--they figure it's a "closed end" case--you recovered, it's 6 months, they can see if he'll fold. Meet with him now. Find... View More

Based on my limited knowledge of the facts, it appears that the person operating the vehicle that lost the ATV would be responsible. However, if you had a last clear opportunity to avoid the accident, you could be apportioned some percentage of fault.

lawyer usually gets paid at each stage depending on the contract and if the stages are defineable. Suggest you sit down with your lawyer to figure out what is going on, face to face rather than over the phone.

Turn it over to your insurance company. You are each partially at fault. She should have been looking and wasn't . You have a duty whatever animal it is to keep it off the roadway. Which means stop it from getting on the roadway in the first place.

If your car insurance has theft protection file a claim with them. You would need to start with regulations regarding holds on vehicles and exceptions you can ask for.

Liability will rest with the at-fault driver. That driver's insurance (assuming he has it) should cover your damages. If he/she does not have insurance, then your uninsured motorist policy should cover your damages. Whether your husband was an excluded driver could complicate a claim for... View More

You haven't said who is at fault. The p;roblem if you do is that usually you will say things that torpedo your case--either the fault issue or the extent of your injuries. You need to talk to a member of the Ark. Trial Lawyers Assn--they give free consults.

Not sure what you mean. If you mean will you be sued, looks like you might. If you don't have insurance worth at least getting a consult on the ticket from an attorney who handles tickets in the county where your ticket hearing would be.

No one can give you an answer over the internet without seeing the report, knowing the light sequence etc. If the light starts out with an arrow then goes to green, if you were stopped and then went on a left turn while other traffic was held, that's different from other light sequences....
