As long as he's not paying you, he has no incentive to sign. You can file for divorce, ask for a hearing for child support going forward as well as reimbursement for past expenses. Speak to an experienced family law attorney about your case.

When you file any documents with the court you have to sign a verification saying it is true and correct. You don't have to wait for him to sign. You can file for divorce and ask for a hearing immediately for him to pay child support.

Q: My ex filed for bankruptcy and was already $4,000 behind in child support. He now owes over $15,000. How can he not pay?

He does have custody of her now but why is the amount still growing and why isn't he forced to pay what he owed prior to bankruptcy?

You may want to consult with an attorney who can review your options and help you with the proper course of action. The arrears will never go away, so he will continue to owe them.

If you file your Answer and Counterclaim in person then you do not have to pay any fees. If you file your Answer and Counterclaim via PeachCourt or E-File Georgia you will have to pay processing fees once to use the portal and no additional fees after that.

Q: who gets child support if grandmother has temporary custody but she lives with me

my daughter lived with my mom age 2-14 but lives with me an has since last year july 2020. her dad pays child support but we dont get it. they keep giving it to her and she dont even speak to my child anymore at all.

If there is a current order of support which shows that your mother has custody, you will need to modify that order so that you have custody and are then entitled to receive the support.

It does not make a difference who files first in the divorce action, it does not mean one party will have preferential treatment over the other party.

If you think your child is in harm or danger, then you shouldn't be ok with joint custody. Presenting a custody case is more than just giving the judge a parenting plan, but more about proving why that is in your child's best interest. Speak to an attorney in your area about your options.

The court can only consider other children if they live with you or if you have a court order on child support for the other children that you are currently paying.

If the CP still lives in Georgia, the Georgia order remains in tact. The GA CS order can be enforced in the new state. the orders cannot be modified anywhere other than Georgia as long as the CP still lives in Georgia.

You should work with an attorney who can help you with the child support and getting you more time with your child. In the mean time, save all documentation that you are paying child support, just in case there are any issues that arise. Keep records.
