I have been waiting for my husband to provide his check subs and sign the divorce documents for overstate vorce documents for over 6 months now. As long as he's not paying you, he has no incentive to sign. You can file for divorce, ask for a hearing for child support going forward as well as reimbursement for past expenses. Speak to an experienced family law attorney about your case.
He wants me too say that we have no minor children in order to get divorced sooner

When you file any documents with the court you have to sign a verification saying it is true and correct. If you are later found out to have knowingly lied to the Court you can be charged with committing purgery, which can carry jail time. You should speak with an attorney to make sure you are... You don't have to wait for him to sign. You can file for divorce and ask for a hearing immediately for him to pay child support.
I am trying to initiate a divorce in Georgia. They require a child support order be in place. However I already pay an existing child support case that is active in Florida.

You can file a divorce case in Georgia without a worksheet. It's possible to keep the same Florida support order. Speak to an attorney about your options.
He does have custody of her now but why is the amount still growing and why isn't he forced to pay what he owed prior to bankruptcy?
answered on Dec 10, 2021
You may want to consult with an attorney who can review your options and help you with the proper course of action. The arrears will never go away, so he will continue to owe them.

You should consult with an attorney who can review the facts of the case in detail and provide you with direction. We need to know if you want your daughter back in your custody or you are just wanting some of the money from SSI. We need more details.

If you file your Answer and Counterclaim in person then you do not have to pay any fees. If you file your Answer and Counterclaim via PeachCourt or E-File Georgia you will have to pay processing fees once to use the portal and no additional fees after that.
child support arrears were included in a modification settlement agreement and included a payment plan toward the balance. Will the principal amount accrue interest if there is a payment agreement?
answered on Nov 19, 2021
THAT WOULD DEPEND ON WHETHER THE AGREEMENT PROVIDED FOR INTEREST TO ACCRUE. HOPEFULLY, YOU USED AN ATTORNEY THROUGH THIS PROCESS SO THAT THE NECESSARY LANGUAGE FOR THIS WOULD BE INCLUDED IN THE AGREEMENT. IF SO, YOU SHOULD SPEAK WITH THE ATTORNEY WHO CAN REVIEW THE AGREEMENT WITH YOU TO DETERMINE... View More

If there is a current order of support which shows that your mother has custody, you will need to modify that order so that you have custody and are then entitled to receive the support.
Child support has ever been given. My question is if my sons father goes to court, can he get full custody? Also what steps should I be taking in a situation like this for precautions? I’m not even sure who technically has custody as of right now. Him or I.

If there is no court order, you have custody of your child. However, it seems that you have been sharing parenting time with his dad, which is a good thing. A court determines what's in the child's best interest regarding custody. If you have your son more now and the schedule is... View More
My estranged husband stated I should be the one to file divorce even though I didn't want a divorce, because if he files I'd be entitled to more support from him or something. Is this true?
answered on Nov 2, 2021
It does not make a difference who files first in the divorce action, it does not mean one party will have preferential treatment over the other party.
I filed a petition to change child custody (my ex has primary, I want 50/50 as circumstances have changed). I provided text message screenshots between the two of us that clearly backed up the claims I was making; however, he and his attorney filed a response that said all the screenshots were... View More

Don't worry about the lawyer says. First, anything you add to the petition isn't considered evidence. In court, you present the evidence to the judge. But send clear copies of your evidence to the attorney ahead of time. Let the judge decide if your evidence is usable or not. But you... View More
I filed for Legitimation and 4 days later child support filed an case. so right now i am currently trying to get them decided on one case instead of two cases but i do not have an child support order already. If you think your child is in harm or danger, then you shouldn't be ok with joint custody. Presenting a custody case is more than just giving the judge a parenting plan, but more about proving why that is in your child's best interest. Speak to an attorney in your area about your options.
I have 6 children. I'm on child support for only one of them due to the mother lying to me about closing the case before the court date. I provide for all children and with this one child support case it's taking away from me providing for my other children as I used to. Does the fact... View More

The court can only consider other children if they live with you or if you have a court order on child support for the other children that you are currently paying.
modified to his new local state? Will the GA CS order follow him to different states if he no longer resides in GA?
answered on Sep 16, 2021
If the CP still lives in Georgia, the Georgia order remains in tact. The GA CS order can be enforced in the new state. the orders cannot be modified anywhere other than Georgia as long as the CP still lives in Georgia.

Please try to rephrase your question. You have not asked us a question. You have only made a statement which honestly does not make much sense.
So I’ve been divorced for awhile now but I’m confused what to go off of. The child support addendum originally stated that I paid 50% up to $300 per child for homeschool, and I don’t have to repeat payment if my ex decided to hold them back a year. I didn’t know, but my ex marked all this... View More

You should work with an attorney who can help you with the child support and getting you more time with your child. In the mean time, save all documentation that you are paying child support, just in case there are any issues that arise. Keep records.
