You should absolutely wait until the end and until after you have a judgment for possession for the premises.

Q: I entered into a one-year lease for an apartment on or about October 15, 2014. The lease was never renewed.

I remain in the same unit. Rent has been paid up-to-date. Can I be given a 30-day notice or do I have an implied one-year lease?

Read the lease to see if it renews.

If not, you are renting month to month.

Either party can give 30 day notice to terminate rental agreement.

It was not an eviction notice.

It was a termination of rental agreement notice.

If you do not leave, then landlord will have to file a lawsuit to evict you.

I would highly recommend consulting with an attorney individually, as this can be a very technical determination that can expose yourself to a great deal of risk if not handled properly. No matter what you do, do not simply end the contract. Consult with a lawyer.

Q: Can a landlord demand $100 a day. When a tenent is waiting to close?

The tenent is waiting to close on a house probably on the August 7th, the last month of the lease is July 31. The landloard wants to charge $100 per day, the rent is less than $1,500 a month. Wouldnt the pro rated amount be $50 per day.

If the lease addresses overages, the lease governs. If the lease does not address this situation, there are a couple of different ways to go about it. Looks like you cancelled your rental agreement by giving them notice you were terminating it.

Landlord is entitled to be paid for any damage beyond normal wear and tear.

Whoever owns the property is the landlord.

It may be the estate.

If the person you were dealing with was an agent of the estate, you can sue the estate.

Otherwise, you will have to sue the person you dealt with individually.

Q: My rent to own tenants stopped paying rent & when I served them, they had moved out and strangers were living there.

How do I find the people on the lease, and find out who the people in my house are? They refused to give their names when the guy served the 5 day notice, although they did accept the paper. I live in Florida, so my brother is handling all this for me in Illinois.
