This is one for the insurance companies to fight out but if you turned into them and they were sitting still then most likely you will be responsible party because you are responsible for your car in movement and making sure to clear obstacles.

I was given the key by the owner. I did take a drive her car for a while before being arrested, whereas the car was returned to either the insurance company or the owner.
