Q: Adultery in the state of Iowa

What recourse does a husband have in Iowa if his wife is openly committing adultery and refuses to stop?? The only respite she is offering is a divorce for which the husband has to pay along with losing half of the assets. She is openly mocking him by saying that in Iowa, he is screwed by the... Iowa is a "no-fault" state, meaning that adultery, etc., cannot be used against an opposing party in divorce proceedings. Additionally, Iowa is a "marital property" state, meaning that any assets, aside from specific exemptions (including inheritances kept in separate accounts),... View More

If the victim was under the age of 18 at the time of the offense, the State can prosecute for sexual abuse in the first, second, or third degree within 10 years of the person turning 18. See Iowa Code Section 802.2(1).

The victim should report what happened ASAP. Waiting makes evidence...

It varies from jurisdiction to jurisdiction and can vary from one situation from another. Simply put it is a false statement that hurts a person's reputation. You are allowed to express an opinion and you are allowed to state facts - everything else is a grey area. Yes, you can be sued even if... View More

Q: Is it illegal for an adult to discuss sexual topics with a minor. (Not about doing things. Just the topic its self)

Like say an adult were to discuss a kink for example with a 17 year old. Just a simple topic or discussion. There is no hint of actually wanting to preform such acts one said 17 year old.

IMO you should forget trying to find out if you can "discuss sexual topics with a minor." Why? Because you are treading into a very dangerous area where most intelligent adults on this side of prison bars do not intentionally go.

You would want to contact an education law support center to find out what your options are.

Certainly, the school isn't providing a safe learning enviornment and maybe initiating an IEP process would be one avenue.

Even though this is the "Polk County" law center,...

Yes. If you are 15 years old, then any sexual act between you and someone who is less than 4 years older is legal. Since you are 15, you would be able to date an 18 year old. In Iowa, the age of consent is 16, but if you are 14 or 15, then a sex act is a felony if the other person is 4 years or... View More

Her boss wrote me a check and asked me if the issue would be dropped. Her boss also said they would have a meeting with her and get her to stop saying the nasty comments and touching me and she still does both. I feel unsafe and uncomfortable going to work. What else should I do? This is a seasonal... View More

Since you put the employer on notice of this conduct, yet the conduct's continued, you may have a claim for sexual harassment/hostile work environment against the employer for allowing the harassment to continue after you complained. That claim would be started through your local human rights... View More
