Hire a private investigator, located his s trial address and serve him with a motion at it.

You should check with the Child Support Division. They are the only entity that can actually correctly answer your question.

They will give them back once the debt has been paid in full or once satisfactory payment arrangements are made with the creditor.

Make a motion in your divorce case to hold him in contempt for 1) arrears, 2) current support review 3) unpaid medicals and 4) your attorney fees. That’ll level the playing field pretty quickly.

Q: I have custody of our son, the father has visitations, does he still have the ability to make legal decisions for him?

Can the non-custodial parent make medical, school, etc decisions for a child just the same as the custodial parent?

If you have joint custody, then yes he does. If you have sole custody, then no, he does not.

Q: How far behind in child support does a non custodial parent need to be in the state of ky for it to be a felony?

I'm owed 2914.77, he knows how to work the system, he pays once every 3 months, I call the child support office for help and they glat out just tell me they are to busy to do anything and that I need to go file a motion at the courthouse, isn't it Thierry job to do this?

You may have a claim against them although there are immunity issues involved. Find a civil rights attorney who can evaluate the case for you.

No. If paternity has been established, you both have joint (not sole) custody by operation of law. You will need to file a motion in the paternity case or a new custody scion to establish a parenting schedule

You have to pay child support through the graduation date in May, but not thereafter.

Q: What does decertified from federal intercept mean?

Last week the non custodial parent was Behind $2000. I looked today and it has the decertified from federal intercept in the case activity and I’m arrears it’s 0.

Most likely they seized the $2,000 for his taxes which satisfied the arrearage. Since there was no remaining arrearage, the claim has been decertified meaning they will no longer intercept his taxes.

You need to file a motion alleging she is voluntarily underemployed and ask for an evidentiary hearing. That way you can get her entire employment history into evidence. Remarriage on either side does not affect child supportlreceipt or payment.

Most likely, it has created an arrearage owed to the state for which you both are responsible. Ask for an audit or accounting from both child support snd from KTAP.

Q: I have my brother in my legal custody. I have since 2016. He is 18 now, can I sue for back child support from parents?

My parents have never paid a dime towards helping with anything and lost custody due to abandonment of child. They left him with me when I was 18 and I’ve had him ever since. He is in college and it would help with his and my expenses for the car I bought him and items needed for classes.

Speed it along. He's literally about to lose the home for his daughter. Why would it take this long? People are struggling, and you know you've got a check sitting with your name on it. That's not right

Go to the child support office that has the check and inquire as to its availability.
