Q: When you are waiting on an indictment is it 60 regular days or 60 business days?

My boyfriend last had court on September 13. What’s the last day that they have to indict while still being in custody? I’m just not sure if it’s 60 days straight or 60 business days.

The charges could be just different enough to charge you in both states if they wanted, yes.

Q: If a defendant were to confess in court yet there no evidence was found for that crime, does corpus delicti still apply?

The defendant confesses to doing crime A and crime B; and there was evidence for crime A happening but there was none found for crime B. If the defendant were then to confess to doing crime B in court, would corpus delicti still apply? Really curious about this, thanks in advance.

If you give a statement to the police, that statement can be used at trial to contradict your testimony.

If people do not have the funds to hire a private attorney, the court will appoint them a public defender. They are pro bono lawyers as they do not have to be paid by clients.

Q: A district judge can issue an arrest warrant for any person in the district but prosecution has to be where judge is?

The district judge can only issue a warrant for the counties in which he presides, no where else.

Q: My husband was convicted of possession of meth his first offense ever. He was sentenced to a year. I’ve filed for shock.

What steps do I take next for the possibility of early release? My husbands father was also convicted of a crime and sentenced to a short prison sentence in 1973. Should he get paroled with they be able to reside in the same house since his dad lives with us?

Nothing much else to be done until the judge rules on the shock motion. You might want to arrange for some aftercare if available to show the judge that he is committed to recovery. I’d make dads status known to the PO is husband is shocked.

You need to hire an experience criminal defense attorney immediately. If you did not commit any crimes other than buying an item at a yard sale, then you should not be charged with theft unless you definitely knew that item was stolen or you had a part in the theft.
