There is no abandonment in this case. You have an agreement. You split the sale proceeds. You get half. She gets half. If the nonpayment was not addressed in the property settlement agreement, then it has to be divided equally.

If everything is agreed to then it is an uncontested divorce and there should be no reason for mediation or arbitration. If everything is agreed to, then it is only a matter of drafting the divorce agreement and having both parties sign it.
