Q: is a E-visa considered a "legal resident of one of the fifty (50) United States?"

I just want extra clarification and reassurance of my interpretation. Since I'm technically "legally residing" in the US, i assumed that would be different from saying "legal citizen," and thereforte I'm a "legal resident." I often run into this question when looking at scholarship elligibilities.

If you live in the US and have a valid, in status visa, you are a legal resident. You are not a "lawful permanent resident." That is a green card holder. You are not a citizen.

You have to maintain "continuous residence" for a period of time prior to filing an application. Absences of six months or more can interrupt. Provided you are not planning on being away for six months or more, and your previous trip was less than 6 months, this should not be a problem.... View More

A civil suit should not affect your admissibility; however, if you are sued and do not show up for court, the court will enter a default judgment against you and you will owe the 25K. Upon your return, the now very frustrated lawyers will claim you left the country to evade the judgment. The court... View More

If you fail to appear in court, a warrant will issue for your arrest. If you attempt to re-enter the US, there are several things that could happen. They could arrest you at the border and seek to extradite you. They could inform you that you need to take care of the case and take your passport... View More

As you overstayed your visa, you have bigger problems than the state ID. You need to get an immigration lawyer ASAP. I suspect something is missing here. People are rarely deported even once for traffic violations. If they bothered to deport him five times, I'm guessing there was a more serious crime or he is barred from entry due to having returned illegally following a prior deportation. You would need an... Q: I have a work permit and plan on getting married to a US Citizen. Do I still need a sponsor to apply for a green card?

I am a non-citizen with a work permit. My fiance is a US citizen. I read that I would need someone to "sponsor" me to show that they can support my stay here. But since I already have a work permit, full-time job, apartment, and a car.. Would I still need one? I'm doing fine living on my own.

There are two separate issues here. First, a US citizen sponsor can mean a family member who is trying to help you get citizenship. This helps move the process along. A US citizen spouse/fiance can get around a lot of the waiting lists for you by sponsoring your application for a green card.... View More
