Without seeing the pleadings or knowing any of the details of your case I can only guess. If the court orders are in Georgia and jurisdiction has not been moved to Oklahoma, looks like you will need to consult with an attorney in Georgia.

If the case has been moved to Oklahoma then you could consult with an attorney in your local area.

It is possible for the court to impute income based on her education, past work experience, and ability to earn. In my experience this is hard to do but is possible.

With that said, be careful what you ask for because sometimes this can backfire if she then starts working and child care...

The mothers income as well as your son’s income is both calculated in the child support calculations. Then then overnights spent with each parent determines affects the percentage of expenses split between the two as well as the amount paid.

I am not sure what you mean when you ask if the income of the mother would offset child support.

The income of both the mother and father is factored into the child support computation. The income of her husband is not considered.

Hire an attorney to help you terminate the alimony payment. Things at the courthouse are moving slow with the weather closings and covid so get this filed asap.

VA is used for purposes of gross income in calculating child support.

Q: Does North Dakota calculate mothers income into child support? We have an agreement but i make much less now.

It states that we can’t file to modify until the 18 months is up. That is coming up. She lives in ND and i live in OK. How will support be calculated for 2 children now that i am making less and in a different state?

If your case/order is in North Dakota then you will need to contact a ND licensed atty to assist you.

I wouldn't do that because if the other parent thinks you have extra money they could try and double cross you and modify support later and you could end up owning more. I have seen this happen before. Other attorneys may have a different opinion but that would be my opinion.

No, but he insurance is factored in to the child support guidelines. He should have an attorney review his support order to ensure it is done correctly.

I talked to the courts in Kansas and they confirmed I don't owe anything

If the support order is in Kansas and you do not owe anything (including not owning any interest) I would encourage you to contact an attorney in Kansas to help you terminate the support order. If everything is paid off you should be able to get it resolved pretty quick.

If all he is worried about is the support then he needs to file for a modification with the DHS office that is handling the support. All you need to do is hire an attorney to prepare a motion and file an agreed order terminating the support based on you living in the same home.

You would have to request the case to be transferred to Oklahoma, which may or may not be allowed. As far as the back support - that will still be required because that is money that you were obligated to pay for the raising of your child.

Q: When filing a child support modification, can subsequent children from remarriage be considered?

We have twins now, which obviously impacts our financial situation. We have a split custody agreement.

There is a credit for other biological children in the home but it really is not that much of a deduction. As a general rule having more kids does not significantly reduce the support owed for the first child.

It sounds like you have a warrant. Hire an attorney right now. It will likely be much better to deal with this head on rather than making law enforcement come find you.

First, don't agree to any support order without first conducting genetic testing to make sure the child is yours. If this has already happened there may or may not be something that can be done now. It is very fact dependant so schedule a consultation with an attorney asap to learn your options.

Child support is not owed to the child, it is owed to the custodial parent. The child does not have a say in support matters.
