Q: If i tell drugcourt i want to goto prison instead of staying on the program can i get isp

They locked me up with no reason and want me to now go to treatment because of the wrong reason and i havent done anything to show that i need treatment

I would make a record that you will ask for ISP and the State doesn't object to you requesting it, but there's likelihood that you'll be denied because they make view it as an attempt to circumvent drug court.

Q: In state of n.j. what does njs 2c :1-1 et.seq mean and is this considered a criminal offense if monies is less than $200

All monies were returned to company. Along with letter admitting monies were taken due to depression.

Person worked for company for 18 years no disciplinary acts on file for individual.

Under $200 is disorderly persons offense. Title 2c specifically states that disorderly persons offenses are not to be called criminal. Police have 30 days to mail you the charges for a speeding ticket and if they take longer then the case will get dismissed based on statute limitations grounds. If cop pulled you over in another town then you can make motion to transfer the case to the other town.

File motion to change venue to the appropriate venue/jurisdiction (town) and there file motion to suppress the stop, search and seizure. You'll need to file formal notice and will have to brief so you'll need a lawyer for that.

Almost never by the Court but IDRC may order it and they do it quite often and the courts almost always enforce IDRC requirements if it gets kicked back to them for non compliance.

Q: I received a ticket for 39:6B-2. Is it possible for it to be thrown out?

I hadn’t received the new insurance card yet, but, the vehicle was insured at the time of offense. I currently have the insurance card to prove it.

If you show the insurance card to the prosecutor they will amend it to failure to exhibit a card which is also a violation but no points no loss of license fine only.

Depends what degree the charge is. If a disorderly person then you're facing max 6 mos. county if it's second degree then bet. 5-10 yrs state prison.

Second degree eluding charge is 5-10 yrs in State prison. Third DUI carries 6 months of County jail.
