I would address this with your parole officer.
Can u tell me if that holds and points. If so instead of paying the ticket do u think it's best to get a court date and plead not guilty? Thank u for help in advance. I truly appreciate it??

She had the placard because her HC plates were in the mail. Placard was perfectly valid
answered on May 9, 2018
Yes.
The placard was just until her handicapped license plates came in. I’ve been a cop for 16 years and our whole department was under the impression to let them be. Unfortunately I guess som people have no compassion for those that need our help anyway i think i have the law on my side , what is... View More

A placard isn't a license to park anywhere without paying, it's just permission to park in designated handicapped areas. I know the answer that you would like to hear but if the question is if you have a valid handicapped placard in NJ can a meter maid give you a a summons for parking in... View More

It will not likely get dismissed because tickets in New Jersey do not get dismissed on basis of technicalities. If cop shows up to court to identify the person who ticket was issued that they'll be allowed to amend the complaint.

You have to go to trial if you are innocent and the prosecutor and/or police officer who arrested you for the DUI and/or the court refuse to dismiss the case without a trial.

There's a step down after 10 yrs for sentencing purposes so you're not enhanced status otherwise it's always there. I've seen abstracts with DUI's back to the 70's.
I was at a bar for a couple of hours, enough to get drunk. My car was double parked and when I get out I went to my car to stay warm while I waited for my girl to pick me up, meanwhile someone had called the cops saying I was driving drunk , but when the cops came I was sleeping .. they gave me DUI... Sounds like State v. Daly defense. Remember, when you hire an attorney it's not guarantee that you won't get suspended you're just paying for the shot of not getting suspended. If your lawyer doesn't even want to give it that shot then either he doesn't believe you have... View More
I am very scared because in PA a rule on my probation states that I cant be around the guy I assaulted on my first charge. But this time he and I were charged in NJ for simple assault on each other. We were not arrested but only charged and fingerprinted. I don't know what to do because if I... View More

In Jersey usually PO wouldn't violate you for a misdemeanor which is what a simple assault in Jersey is (disorderly persons offense) especially if you have a good relationship withe the PO, however, if there are other violations while on probation such as no contact or restraining order... That statute violation number doesn't look familiar at all. It may be a PA or NY matter or some other state unless it's a local municipal ordinance in some Jersey town. I would contact the court in that town or an attorney in those states first if I was you.
I want to express my freedom of speech and draw with chalk on the sidewalk and street but unsure if it is illegal
answered on May 3, 2018
Rule of thumb is that if you exercise freedom of speech at public's expense you will lose and the public will win. You can draw chalk all over inside your house and apartment and exercise freedom of speech that way but once the public is exposed to it the police get involved. Even if you win... View More
I was represting myself for first appearance and want to know if eligible for court appointed attorney, can I request at any time during the matter?
answered on May 2, 2018
You need to fill out a 5a form and ask the court to appoint the atty for you and they won't do it on the spot they'll rescheduled for the atty to get copy of the file and speak with you at the next court session so you're looking as more court appearances for that.
Ticket is from town a but cop is from town b and court is now in town b. Is there a formal way to request to change venue or a blank change of venue?
answered on May 2, 2018
File motion to change venue or hire a lawyer.
If an officer give me a ticket and court is from his township and not the town it o ccured can I request to change courts to where the infraction occurred?
answered on May 2, 2018
My answer is that the ticket belongs inside the venue it was issued so if the ticket was issued in town a and the cop is from town b the ticket belong in town a rather than town b. The jurisdiction is where it was issued not where the cop is from.

I was charged with having a gun and shooting the gun at someone but the victim signed a alfaDavid saying it was not me but I have a public defender who wants me to ple out to it what should I do ?
answered on Apr 28, 2018
Take case to trial and have your lawyer subpoena the victim who signed the affidavit but if the prosecutor has other evidence then the jury will decide who they believe.
I was pulled over for a broken tail light and being on my phone. I asked officer to articulate how he seen me on my phone, he could not articulate how I was on my phone and went to say my tail light was out. I wouldn't fight a tail light ticket but if you have to then file a motion to suppress the stop.

It all depends what degree the charges are and his past criminal record and background and whether he already served county or prison time before. Also, has he kicked the habit? He's facing anywhere from fines to a criminal record, probation, community service and even jail.
Worst answer ever. Totally useless. Did I do something to be awarded with such a dismissive answer?
