The usual rule is that if there is an increase it would from the date the petition to modify was filed.

What are the circumstances.

Did she send the child to Florida to be with her sister for the winter.

How about the non-custodial.

Don't they know. Don't they care.

If you do, and the custodial parent wants you back, they can have the police help them get you back.

If you can't find a will, then the presumption is that there is no will.

The nearest of kin needs to go to court and be appointed administrator to open and administer her estate.

The county clerk should give you a voter ID card.

That is what you need.

Otherwise, usually they will accept any form of picture ID.

The Secretary of State issues State ID cards.

If there was a support order and he didn't pay, then the back amount belongs to the mother.

She can collect.

There is no time limit.

The child support does not belong to the child.

The Mothers husband paid support because he took him as his.

Looks like in the divorce it was found that the husband was the father and he paid support.

There would have to be another court order to make someone else the father.

Nothing gets done unless you file a paternity case first.

Once he is determined to be the father, child support will follow.

So, this is in probate court.

That is where you need to bring this up.

Maybe you can buy it from the estate in lieu of your inheritance.

What you are looking for is a parenting plan. The parenting plan spells out who make decisions for the kids and who who has them and when.

Having a job is not integral to a parenting plan.

You can move but the problem is if she files in Florida.

Then you will have to deal with it there since the kids have lived there the last 6 months.

The question of which court has jurisdiction is very complicated.

The first question is where you can file the paternity case.

Usually it's the mother filing paternity against the father and she can do it in Illinois even if he lives in another state as long as he got her...

Q: 4 adult sibling were left a home, no mortgage. One sibling owes IRS $20,000. Cant sell. What can we do?

Adult who owes money to IRS has tried to work with IRS---IRS said no. Judge now says house has to be sold to pay IRS. What about the rest (3 adults) of us who have an interest in this house? We were told by real estate agents the house could not be sold with a lien. How can we sell it?

How did her mother's information get on the ticket.

Or is it just a matter of writing down the wrong name.

The State can amend the ticket to correct the name.

You are free to hire any lawyer you wish but he or she must be authorized to practice law in Illinois.

She lets me see my kids when she feels like it. Some times she changes her mind after telling me that I can have them for the day. Do I have any legal rights at all?

You do have legal rights.

But they need to be established with a court order.

If not already done, you need to file a parentage case and ask for a parenting plan with times allocated to you to be with the children.

You can move wherever you want.

The only catch is that he may file for divorce and a parenting plan in Illinois.

Divorced people move in with others all the time.

Check to see if the parenting plan addresses the issue.

If you are concerned, you could try to amend the existing orders to prohibit him from having the child there.
