Hello. Terminating his rights does not end the support obligation he has for the child. You need to contact DHR or hire an attorney who can establish custody and child support for you when the time comes (in about 6 months). Best of luck.

Q: Can I ask for a certain amount of money in a divorce after only 3 months?

He recently physically beat me and was jailed for domestic violence. I also quit my job because he wanted me to and promised to take care of me. This is my first marriage and I'm 47 years old.

You can always ask for it. Whether or not you receive it will be up to the judge who hears your case.

Hello. She would need to ask the Court's permission or get him to submit to a test voluntarily. Weed is illegal in Alabama. I've yet to see a Judge disallow a parental child support agreement. You still must file the child support forms as a matter of record in your case though. Thanks for your question.

We settled outside of court. We never had to see the judge. The judge made our agreement a court order. I’m married now, can she take me back to court to request more money?

Yes, either of you can always go back and request to recalculate child support.

Hello. No, it will not be legal unless and until it is a court order. Otherwise, you are at his mercy of when and how much he decides to pay. Contact DHR or hire an attorney to file for CS. Thanks for your question.

Q: Can defendant in uncontested divorce sign waiver to avoid response period or default judgement and proceed immediately?

Everything is agreed upon, he agrees to proceed without dispute. Does the waiver exempt us from needing to file an answer or wait through the response period

Hello. Unless she is disabled and unable to care for herself, then it terminates on her 19th birthday. Any money received by the custodial parent after that date is subject to claw back, should the non-custodial parent decide to legally pursue it. Thank you for the question.

Q: Will child support be ordered with uncontested divorce with equal custody (3.5 days each) and both decline support?

We both maintain similar homes and expenses related to the children. One parent does make 66% of joint income.

Hello, uncontested means child support will be addressed in your agreement. The Court will make whatever your agreement is the Final Order. So, no, unless you both agree. You will still need to complete the child support calculation forms so they can be filed on record. Best wishes.
