SECOND: Depends on which state the transaction took place. For instance, if in California, the answer would be “no.” An “as is sale” must be clearly stated in writing. Attorney fees might be recoverable.

The Civil Rights Act of 1991, 42 U.S.C., sec. 1981; et. seq. [including section 1983] is probably the law to be used. That Act adopts a state's statute of limitations period for personal injury claims as the time limitation. The issue being: in which state did the imprisonment first occur?

Sounds like your son was severely by police in Antioch. If so, your son - not you has the right to bring a claim or suit. If your son is a minor child (less than 18byerars) you or another adult would be bringing the claim as your son's "guardian ad litem": an adult responsible to your son.
