You can't stop him from filing a legitimation case. Fathers are presumed to be able to figure out how to parent just like you figured it out. When he files, you can hire an attorney to respond to the case. In the meantime, unless he has a severe drug, alcohol problem or something similar,... View More

If police need a warrant for this, and it is unlawful for a private citizen to do so, wouldn't it also be unlawful for a PI to do the same? If lawful, why could information gathered this way be admissible in child custody cases when if gathered by a private citizen or law enforcement agency it... View More

It is not illegal for a PI to place a tracking device on a car that the client owns or that is in a public place. It is admissible in custody cases and not the same as a criminal case.

You cannot get your money back. You need to file for custody and a child support modification.

You haven't asked a question, but if your question is if a person on section 8 can get custody, the answer is yes.
Can I make these changes without going back to court?

If the other party agrees to the time change, it's fine. If not, you will have to go back to court.
We were married in TN but I live in GA. No kids or property. Separated 5 plus years. I'm not seeking alimony or spousal support
answered on Mar 29, 2022
If you can prove you have made every effort to find your spouse, then a court here may give you a divorce by publication. Essentially after you have filled out an affidavit that proves you have attempted to find him, it will run in the paper for 6 weeks, and the divorce can be granted after that... View More
My support order was pushed back another year and half until the judge finally put the order in. Now I am being denied retroactive support even when Covid is the reason.

No. A private attorney can often obtain a child support more quickly, but you can't collect support from before the order was entered.

The short answer - it's possible. As the other attorney noted, you may not get to keep all of the equity. If there are other assets that can offset the equity, that might help. You should contact and attorney immediately to have a consultation so you can discuss your options.

There is a very narrow set of circumstances where grandparents can get rights. Parents have the right to determine who sees or does not see their child. If the child did not live with you at any point, it's unlikely the court will grant a visitation request.
Papers have been signed and notarized by both parties.

It depends. If all the paperwork was done correctly, usually the defendant does not have to attend. The plaintiff can attend and finalize.
However, if the paperwork was not done correctly, then the divorce may not be granted at all. Out of an abundance of caution, I would attend the... View More
Alimony is stated as lumpsum, non modifiable but it goes on to detail a schedule of periodic payments ending in 2026. Because of this contradiction I am asking for the modification or for it to be overturned.
answered on Mar 16, 2022
If there is a schedule of payments that has an end date and a total discernible amount, it likely is nonmodifiable
I'm not familiar with the child support laws in AL but it seems that child support is determined by how many minors and both parent's income. Is that correct? So if I have a client who is getting $500 for two kids, the youngest kid is 10 and the oldest is 17. So will child support be... View More

Unless the order specifically states that the support will drop to a certain number when one child ages out, the support continues at the current number until the 2nd child ages out. In most cases, this isn't a problem because the person paying child support may be earning more money, so the... View More
