You don't have to wait for him to sign. You can file for divorce and ask for a hearing immediately for him to pay child support.

An unmarried father has no rights to custody or parenting time until he files and goes through the court legitimation process. He is still required to pay child support, however.

Q: Divorced in 2007 need to file a QDRO was told Dekalb Co. pension will not accept the QDRO form. Is that true.

Was told they do not accept the QDRO that I will have to wait until my ex spouse retires and that he himself will give me whatever money is coming to me, That doesn't sound right I need help.

It may be right. There are some government retirement accounts that are not divisible. The spouse has to voluntarily pay upon retirement. This is something that should have been accounted for in your divorce order or agreement.

Who signs first is not relevant. It may still be considered marital property and the court will divide it fairly.

Q: I retained a lawyer two years ago and nothing has been done. I paid a deposit and have yet to receive help. Help!?

I paid a retainer and have spoke to 4 different paralegals in two years. Nothing has been done other than a few questions last year. I have not paid my balance because she never did anything initially. It's a case of fraud from a divorce by publication.

There are no forms for emergency custody superior court. The petition is written by the person seeking the change and filed, but custody cases, and emergency ones are unique so there is no form for it. Speak to an attorney about your case.

If he is your current husband, there isn't much you can do. If one of you files for divorce, the custodial parent will be determined at that time.

If you are dealing with child support, then you do need a child support addendum. However, if you get married, the marriage itself legitimate the child, so you don't need to legitimate IF you marry the mother of your child.

It's not kidnapping. You both have equal rights to the child. If this continues, it's probably a sign your marriage is not headed in the right direction and you can file for divorce or separation and get a custody order.

The fact that she is gay does not have anything to do with the question of alimony. There are many factors that go into whether or not alimony will be paid, including your respective incomes, infidelity, work history, etc. Consult with an attorney about your specific case.
