You telling him to take you to court about parenting time is contempt. However, if the parenting plan allows for him to pick up the child from daycare on his weekends, and he has chosen not to, you may not be held in contempt. If you feel that parenting time would put your child in a dangerous... View More

Is there a case to request the State to remove mandatory visitation rights from the absent parent?

There cannot be a definitive answer to your question. You need to consult with In attorney about your specific case. The age of the child definitely makes a difference. A 5 year old is not going to be able to opt out of parenting time, but a 15 year old might to be able to.

Will this help me in the divorce proceedings?
answered on Oct 19, 2023
There isn't enough information to tell if it will "help" you. If you have children, it could be relevant to custody. If it's a long term marriage, it could be relevant to alimony. You need to speak with an attorney about all the facts so they can give you advice.

There aren't forms for that. You will have to file an Answer and state your objections, which are unique to each case.

No, you should not take your child to the hearing. You should file an Answer and contest legitimation. Do not wait until the hearing.

He's allowed to leave and not answer calls. If you have minor children, that will affect custody and its a crime not to support children. Nevertheless, it seems you may need to speak with a divorce lawyer about your options.

It is highly unlikely that you can move.a case because you feel the judge is against you. The judge is allowed to make judgment calls, and they may not be in your favor, but that does not mean you can prove it is for an improper reason.

If you have proof that it was a gift, you may not have to get it back. But, they also could shut off the service. I'd suggest a compromise where you get to port your number out to a new phone and you give the phone back.

The law requires that you have to be a resident for 6 months before filing. You can speak to an attorney about whether the temporary time in Florida makes you have to start over with the 6 months.
