Yes, if you file a Chapter 13 Bankruptcy case, and if you are the successor to an interest in real property, then your interest (whether a whole interest or a part interest if more than one person inheritys) is part of your bankruptcy estate. If you simply did nothing, did not appear in court, or submit your ticket with an explanation or payment, then the Court likely entered a default judgment against you and assessed fines. Q: I need to file chapter 7 to stop a garnishment I can't afford. How do I stop it so I can pay for the BK

I get paid once a month and my net is 2400.00 the garnishment takes 600.00 which leaves me a net of 1800. Once I pay rent & utilities, I have a few hundred left for food and gas. I need to be able to save up for 60 days so I can pay for the BK but I can't do it if I continue the garnishment

You should go to the Court where the judgment was entered and file a request to pay the judgment in installments. Yes, you can. And, when determining whether you are eligible to file a Chapter 7 case (whether you earn too much money to qualify for Chapter 7) , under the Means Test, the Court will not consider your Social Security Income.

It depends on whether she files Chapter 7 or Chapter 13.

I agree with Mr. Morris. Courts generally will not permit an individual to have two bankruptcy case pending at one time. However, if your business is incorporated, then you could file a Chapter 7 or 11 in the corporatation name, and file a private Chapter 7 or 13 as an individual.
