Q: Under 21 and caught with less than 28g

I was in a university of california campus, and i was caught with marijuana less than 28g, while also being under 21, will i be fined the state citation or a federal citation?

They did not take my license they gave it to me. I just want to make sure if I need a hearing at the DMV if I was not given a revocation or a suspension letter.

DMV WILL NOT DO ANYTHING B/C IT WAS MJ AND NOT ALCOHOL.

THE DA MAY STILL THINK THEY CAN GET A GUILTY VERDICT BASED ON THE FACTS

DO NOT HAVE IT IN THE CAR TO BE SAFE.

a lawyer needs more info.

some courts use interlock others are not as demanding.

it is not a question of whether you need it but rather whether the DA and Court ORDER it.

it sounds like you have 2 within 10 years and another outside of it..........

for sure they will ask for jail but with a good atty and a little luck you should be able to get home arrest

and AA and rehab are all good but i would think it should be as intense as possible.

in indio court they always ask for jail on a 1st offense dui let alone 2nd and 3rd. However if filed as a misdemeanor you can ask for home arrest...

It is 10 years, so if you get a DUI today it goes back 10 years.

When you got your DUI before it went back 7 years from the date of your past DUI.

The law is current from when you get your new DUI not when you had received your DUI in the past

the vaping might give the officer the suspicion you are smoking MJ so he arguably has the right to investigate...........when you roll down the window or open the door if he smells or sees an illegal drug he can arrest.

You can always contact the county district attorney’s office to determine what happened to the charges. If there has been a decision not to prosecute, they will inform you of that. It is probably safer to go online to the court’s website and check the status of the citation in that way.

if you are over 18 they are all adult DUI

a conviction for a 3 DUI would result in a license suspension of 5 years.............and the court would be looking for a decent amount of time in custody.

you need to ask this of an immigration lawyer not a criminal lawyer.
