When the officer pulled me over, he asked me how fast I was going and I admitted to 70 and he said 74. During this stop there was a liquor bottle on the floor in the front passenger seat left from the weekend before and since this was also a recently purchased vehicle, I didn't have our... View More

No. That is not a basis for dismissal. As art of the discovery process, you can get a copy of the citation and the police reports. There may a basis for a challenge, but a different officer’s name isn’t going to be the basis for challenge.
Of my vehicle. Would I still have to pay the fine?
answered on Feb 27, 2022
The police officer writing the wrong year, make and model of the vehicle on a speeding ticket would not automatically make the speeding ticket void. Not paying the ticket and not contesting it in court, would result in the listed driver being convicted. The state could then pursue collection... View More
His badge number on the citation could I try to go to court and have this citation dismissed? This was a citation for expired tabs
answered on Feb 5, 2022
No. That is not a basis to get the citation dismissed. There may be other issues going on that could help, but this won’t be one of them.
Winona County.
answered on Jan 12, 2022
The issue is not the residency. The issue is whether the ticket is charged as a misdemeanor or a petty misdemeanor. A petty misdemeanor does not carry the possibility of jail time and consequently you would not be entitled to court appointed counsel. But you would if the charge is filed as a... View More
If I am in the left turn lane, with my left blinker on, and 30 feet before the crosswalk while moving forward I blinker right and get back into the lane that goes straight through the intersection, is that against any traffic laws? The police need reasonable articulable suspicion to pull someone over. There isn’t necessarily anything illegal about what you did, but other factors might’ve played a part in why you were pulled over. Speak with attorney directly about your situation for more specific answers about your situation.
I haven’t had a speeding ticket in 5.5 years. I don’t mind paying the fine, I would like to avoid the insurance hike. Is it possible to get a continuance for dismissal based on my driving record or will previous tickets remove that option altogether? Ticket was issued in Steele County, MN.
answered on Dec 27, 2021
The bigger issue for you is the county where the citation was issued. Not all counties give continuances for dismissal during the negotiation process. They are far harder to come by the further from the metro that you get. Steele County may not offer continuances for dismissal as a matter of... View More
Do I have any recourse for time lost fighting this false Citation?
answered on Nov 26, 2021
Get representation. Fighting it yourself is unlikely to be successful. Generally speaking there is not any compensation available even if you are successful challenging the citation.

It depends on your county and whether this is a first offense. It’d be better to speak with a lawyer.
2 way stop/4way intersection. Bus flashing red across from me but stopped at least 30’ before stop sign.

You cannot continue driving if the stop arm is extended with the lights flashing in a circumstance such as this. A citation could be headed your way.
A few months back I was pulled over for speeding. The officer asked if I had been drinking and I told him that I had a few drinks earlier in the night. I performed some Field Sobriety Tests and was asked to use a breathalyzer. The breathalyzer showed a blood alcohol content of .079. Being that the... View More

The ticket is public information and the insurance company can certainly access it if they want to. The bigger question is whether the company will seek it out.
Can I contest it and report that? Is it worth it/will it get me out of my ticket?
answered on Oct 1, 2021
Yes, of course, every speeding ticket can be contested, and should be. Focus on the desired outcome. Perhaps that can be met by agreement. Next, gather all facts and keep an open mind to all possible legal defenses. That defense may be the best available, or another might be better. If it's... View More
I'm a Minnesota resident

If convicted (by paying the fine or losing a trial), yes. Wisconsin will report the conviction to the Minnesota Department of Public Safety for inclusion on the driver's license record (assuming a Minnesota driver's license). To avoid that, fight the ticket in Wisconsin to try to... View More

i was trying to know if I can go on probation for the ticket I've received
answered on Sep 16, 2021
There isn't really a question here. Were you charged with speeding? Have you already paid the fine and consequently plead guilty to the speeding ticket? You need to more clear on what you are asking for anyone to help you.
I was within about 30 ft of a speed limit sign that stated 60 mph. I took a picture of it thru my dash. Thought if I was within sight of the next speed limit sign, I could justify that speed?
answered on Aug 21, 2021
The speed limit becomes effective at the sign. You could certainly argue that you thought the speed limit had increased. But it also depends where the officer clocked your speed.
He received a speeding ticket 08/01 and another 08/17/21. I am beside myself but at any rate, I'm more concerned about his driving record and insurance, the 08/01 the officer gave an extreme speed but it's payable. There's no way my son could've been going that fast with the... View More

Yes, doing whatever can be done to minimize the consequences to his driving record and insurance rates is worth an attempt. The consequences to his insurance rates are going to be incredibly expensive and hiring an attorney may be less expensive in the long run. Additionally, the speeding... View More
Cruise control was set for 30 miles. When pulled over I was told it was for speed. I asked how he measured my speed and he refused to answer. Wrote me for 73 in a 60. How do I request dash and body camera video for court ?
answered on Aug 16, 2021
You can certainly enter a not guilty plea and request any dash and/or body cam footage as a part of the discovery process.
On July 18th I was cited for following a car too close as he was turning right in front of me on a 35E exit to pilot knob road which is a two-lane road. The effect that this might have on your insurance rates depends on your prior driving record and your insurance company. There is no mechanism for tickets automatically coming off of your driving record absent some type of agreement with the prosecutor. I don’t necessarily expect it to affect a... View More

I was pulled over for not stopping at a stop sign in Minnesota (I'm from Texas) but when she came back to the car with my license, she said that she couldn't give me a ticket to sign because her printer was broken. Can I get out of this ticket because of that?
answered on Jun 28, 2021
No. You are not required to sign a ticket upon receipt in Minnesota. There may be other ways to avoid the ticket or to keep it off of your record, but the printer being broken is not one of them.
I received a ticket for speeding in a special commissioners zone. Speed limit dropped from 55 to 40 in front of a State Park parking area but I don’t recall any yellow warning signs about the speed drop. The ticket is for 59 in a 40 and I’ve read that anything over 15mph over stays on record... View More

Representing yourself is never a particularly good idea. You have some misunderstandings about the law. First, a ticket, at least in Minnesota, remains on your driving record permanently. I've seen folks with stuff on their driving record going back decades to the 90's and even the... View More
