No. That is not a basis for dismissal. As art of the discovery process, you can get a copy of the citation and the police reports. There may a basis for a challenge, but a different officer’s name isn’t going to be the basis for challenge.

Of my vehicle. Would I still have to pay the fine?

The police officer writing the wrong year, make and model of the vehicle on a speeding ticket would not automatically make the speeding ticket void. Not paying the ticket and not contesting it in court, would result in the listed driver being convicted. The state could then pursue collection... View More

No. That is not a basis to get the citation dismissed. There may be other issues going on that could help, but this won’t be one of them.

The issue is not the residency. The issue is whether the ticket is charged as a misdemeanor or a petty misdemeanor. A petty misdemeanor does not carry the possibility of jail time and consequently you would not be entitled to court appointed counsel. But you would if the charge is filed as a... View More

The police need reasonable articulable suspicion to pull someone over. There isn’t necessarily anything illegal about what you did, but other factors might’ve played a part in why you were pulled over. Q: Speeding ticket for 70 in a 60 in MN. Clean record for previous 5.5 years. Can I get a continuance for dismissal?

I haven’t had a speeding ticket in 5.5 years. I don’t mind paying the fine, I would like to avoid the insurance hike. Is it possible to get a continuance for dismissal based on my driving record or will previous tickets remove that option altogether? Ticket was issued in Steele County, MN.

The bigger issue for you is the county where the citation was issued. Not all counties give continuances for dismissal during the negotiation process. Get representation. Fighting it yourself is unlikely to be successful. Generally speaking there is not any compensation available even if you are successful challenging the citation.

Q: School bus-stopped back 30 feet from stop sign, me-stopped at opposing stop sign. I took a left. Legal or not?

2 way stop/4way intersection. Bus flashing red across from me but stopped at least 30’ before stop sign.

You cannot continue driving if the stop arm is extended with the lights flashing in a circumstance such as this. A citation could be headed your way.

Q: i have convicted of a petty misdemeanor due to speeding 75mph on a 40. I was rushing due to family restrictions.

Have time a curfew at the house and didn't want to arrive home late, so I had to rush to get home fast and, my mom was sick, so I had to take care of her in all ways, so I had to sacrifice myself for hers.

Q: Got a speeding ticket for doing 49 in a 30 mph zone (exiting a small town) - HOWEVER -

I was within about 30 ft of a speed limit sign that stated 60 mph. I took a picture of it thru my dash. Thought if I was within sight of the next speed limit sign, I could justify that speed?

The speed limit becomes effective at the sign. You could certainly argue that you thought the speed limit had increased. But it also depends where the officer clocked your speed.

The effect that this might have on your insurance rates depends on your prior driving record and your insurance company. No. You are not required to sign a ticket upon receipt in Minnesota. There may be other ways to avoid the ticket or to keep it off of your record, but the printer being broken is not one of them.
