Q: warning for offense 39:4-32 pedestrian crossing roadway signals

if you receive a warning in new jersey for failing to stop for a pedestrian in a marked crosswalk will that increase your auto insurance rates. Not a ticket but a warning. I have a camera in my car and the video shows nothing except a cop waving to turn left. Can I contest this ?

A ticket filed in the municipal court is required before direct and collateral consequences become an issue. If a police officer gives only a warning, then the court, motor vehicle commission, and insurance company should not find out about the encounter.

Yes you need a good traffic ticket lawyer as you are probably charged with allowing an unlicensed driver to drive your car. If you get convicted of this offense which is I would assume 39:3-37.1(a) which carries a fines up to $500 and or up to 15 days in Jail. Thus yes you need a lawyer and a good... View More

You can try to go to court and fight the ticket but many judges will consider the apron part of the driveway and thus you blocked it.

Q: What is the procedure to pleading not guilty for a parking ticket? Ticket on vehicle had ordinance no. 39:4-135
H. Scott Aalsberg

answered on Oct 14, 2022

Its not an ordinance its a state statute. As for how to dispute the ticket the best way is to send a letter to the court saying that your disputing the ticket and wish to plead not guilty. Then the court will setup a trial date to present your defense.

The answer depends on your towns rules and parking regulations as they do vary by town. But many towns do not allow this type of parking. Thus I suggest you have your car towed immediately to avoid a ticket.

There is also the possibility that the prosecutor will have the officer’s handwritten notes indicating that the officer already gave you a break when he issued the speeding ticket to you. That's the same as the police officer motioning/telling you over his speaker to slow down. That doesn't mean that he can't give you a ticket later for speeding at that time. So yes you can still get a ticket for what happened.

Q: Is there a legal distinction between the terms “roadway” and “highway?” Are they interchangeable?

For example if a section in this law refers only to “highways” does that law apply to all roadways? In regards to a pedestrian moving law.

It would depend on the statute where each one is written. Don't forget that statutes are written in different years and times so many words may mean something then and something different now, you have to look at the definition at the time the law was passed.

Q: How much time or distance does the law state that you have to pull over when an emergency vehicle comes up behind you?

I was pulling a travel trailer and can't be expected to stop the same as a car!

50 seconds & less than 1 mile does not seam reasonable. I just viewed a copy of the dash-cam disc.

Why do I feel this is loosely determined by the officer and how he felt that day?

No set mileage is in the statute, but if you look at the cases its a reasonable distance/time. The problem is some people just aren't that aware of their surroundings and thus don't pull over right away even though the cop was behind them, and then they get the charge. if charged make... View More
