Q: I have violated code 40-8-90 without knowing it was a law is there anyway i can dispute this ticket.

The office that made the stop told me he was not going to give me a warning because of other people he said in his own words "most people that he tells to changed there lights do not so instead of giving warnings he gives them a ticket on the first stop".

There are several ways to fight this type of ticket, depending on which court you end up in.

But regardless of which court it is, ignorance of the law is not a valid defense.

Q: Can i fight a failure to move over for emergancy vehicle ciation, i slowed down and left lane was blocked?

I had a car directly to my left, so i couldnt merge over. However, i still slowed my car the moment i saw the cop car. Which was to 60-59mph. (speed limit 65) Is the ticket still valid? (ATL, Georgia)

Call the court as this is a common occurrence. They will confirm the disposition of the case on the phone and for best practices you should get a copy of it for your records.

Nothing to worry about, you just want to make sure everything was done right.

Q: I received 2 photo citations by mail however the speed posted is incorrect on my ticket . The speed limit is 35mph

Not 30 mph. I videotaped my entire drive to my sons school and back and at no time is the the speed limit posted as 30mph, only 45mph and 35 mph. What can I do?

Show the photos to the prosecutor at your arraignment. If that does not work, ask for a continuance and bring a lawyer to your next court date.

This is my first offense and they also booked me for operating without tag. It wasn’t my car but I did know it wasn’t good. I’m about to graduate and I really don’t want to stress about maybe getting jail time. I don’t know how serious these offenses are

99 in a 70 is considered a super speeder citation in Georgia. It may be wise to get an attorney to help increase the chance that you can save your license.

There is no reason not to sign the tickets, because by signing you are only acknowledging that you received the ticket. You are not admitting guilt. Some officers have been known to arrest someone for Obstruction of Justice when a person doesn't sign.

If both charges are consolidated into a single case, you can use a nolo plea to resolve the entire case.

You may not want or need to plead nolo, though, depending on your exact circumstances. You should consult with a traffic attorney for your best course of action.

Missing payments is actually not that big of a deal, so long as you can demonstrate your financial hardship to the court.

Missing your reports, on the other hand, shows the court that you aren't taking the court seriously.

Q: Hi, I was given a ticket for hitting a vehicle parked on the highway median. No one was in the vehicle.

FAIL TO NOTIFY OWNER/FIXED OBJ STRUCK (40-6-272). I was picked up by ambulance and taken to the hospital. The policeman gave me a ticket while I was lying down in the ambulance for not contacting the owner of the vehicle I hit. Can I dispute this ticket and have the ticket removed from my record?

Yes, they can sue you, and if they win, they can take collections actions against you to collect on their judgment.

If they have uninsured motorist insurance coverage, their insurance company can sue you, as well.
