Yeah I was never compensated for my medical bills and I feel that his insurance should have paid

Contact a member of the Indiana Assn for Justice that handles comp claims--they give free consults. As to the air bags, depending on how the crash happened the air bags would not have gone off as they only go in certain circumstances.

Your facts are not as clear as they might be. If you are saying that you misjudged the speed of a car which had the right-of-way and you got hit, the accident is clearly your fault, irrespective which gear you were in.

The insurer is required, by statute, to let you know, in writing, that your insurance has lapsed. Most insurance companies make the advisement BEFORE the policy expires/lapses. So, his defense is that WHILE HE WAS ON PROBATION, he got so drunk and so high that he crashed his car and injured one or more other people? This must obviously be discussed with an experienced local defense attorney ASAP.

Q: I'm in Indiana, my father passed away. He was arrested & scheduled for court. Why do they not just drop his case?

He was arrested for leaving the scene of an accident. My husband bailed him out. If they don't drop the case, do I take his ashes so he's present? I mean what do they logically expect from us now? His 2nd court date was this morning and they're "undecided" at husband's last contact.

Q: What do I do when I was a passenger in a single vehicle car accident and the driver didn't have insurance?

Q: if you obtain a police report are you required by law to file it with your insurance?

Had a small fender bender and when I asked for a police report officers said I had to file a claim with my insurance or have my lisence revoked. is this true even if I was the person who got rear ended?

No, he's --or you--have mixed it up. You file with the other insurance if it's a rear ender. However if you were hurt, call a member of the Texas Trial Lawyers Assn--they give free consults.

Q: I was hit by an uninsured driver, my car was totaled out, other drivers fault. settlement from my ins, Can I still sue?

I received a settlement from my Insurance, but I am still out because I just paid the car off and didn't get enough to purchase a car out right. Now I have another monthly payment. Other driver gave false insurance info to police at scene. Can I sue for the money I now have to pay again for a car?

Provided that your son was a "licensed driver," it should be covered to the policy limits. This is an unusual claim.

Q: We were in an accident. The other driver was at fault and ticketed. Neither party had insurance. Can I sue?

He refuses to pay because neither had insurance, but he was the cause of the accident and the officer wrote him a ticket for causing the wreck. Can I take him to small claims court? The wreck caused $6,000+ in damage to my car. Am I stuck with this bill because I also didn't have insurance?

You absolutely CAN sue them. As long as you advised the Indiana BMV, even without suit, their license will be suspended until they enter into a repayment agreement.

Q: My friend with insurace backed into my noninsured car in his driveway.

Your car being parked has nothing to do with it. Your friend is responsible for any damage that occurred when he hit your car, up to the fair market value of the car.
