Not sure why she couldn't get a public defender for the theft & resisting charges. She needs to see why that is. If you were not driving and another hit you negligently, then yes, you do have a claim against the negligent driver. There is a two year statute of limitations in Kansas, and you amount of recovery will be dependent on the extent of your injuries.

Q: I was backing out of my parking spot, and a car drove behind me without it's lights on. We barely hit. Who's at fault?

You may. Generally you will be found at fault as you are the backing vehicle, however if it was dark and she had no lights you may have a claim.

They will try to get him to say he torched it--which is dumb because replacement costs more. Contact a member of the Ks Assn for Justice who handles "bad faith" claims --they give free consults.

Q: I got into a car accident 4.5 months ago. How long after the accident do the cops have to ticket me?

Accident wasn't my fault. Someone backed out of off street parking spot and they hit me. I was already behind the person when they put the car in reverse.

technically, the charges can come through quite a while after an event, but practically, if you don't get a ticket within a day or two, or at most a week, you are not likely going to get one. From the facts you mentioned, it doesn't sound like you should get any ticket in any case.

Yes, as sometimes it take 5 weeks to get test results back. Suggest you contact an attorney who handles DUI's in the county where you will be charged.

Q: My son has to go to court for not stopping at a stop sign he hit a car what will happen

He hit someone but no one was hurt and the ticket just says not stopping at a stop sign

If he is going into the service (for real not a "I think I might" ) then cop may move it down to a non-moving violation.

Otherwise, he gets points, his insurance will go up.

Anyone can say anything. If she turned left, unless it was on a turn arrow and you had the red, you have the right of way. If you were hurt contact a member of the Ks Assn for Justice--they give free consults.

Q: My car was parked on the side of a parking lot and was hit when a person backed into it. The insurance company claims I

Q: My car was hit in a rental car parking lot while I was renting a car from the rental company.

They claim that because they posted a sign, which I did not see, that says they are not responsible for theft or damage to a vehicle in their lot they have no responsibility to do anything about the damage. Is this true in Johnson County, Overland Park Kansas?
