Not sure why she couldn't get a public defender for the theft & resisting charges. She needs to see why that is. It will help if she checks with the bar association to see if there are any volunteer attorneys etc. That way if she goes to court she can tell the judge what she did to find an... View More

If you were not driving and another hit you negligently, then yes, you do have a claim against the negligent driver. There is a two year statute of limitations in Kansas, and you amount of recovery will be dependent on the extent of your injuries.
While I was backing up, the car sped up to try to get around me before I was fully backed out. It made a small scrape on both of our cars. She filed a police report against me. But she did not have her lights on, and she sped up intentionally while I was backing out. Should I file a claim against... View More

You may. Generally you will be found at fault as you are the backing vehicle, however if it was dark and she had no lights you may have a claim.

They will try to get him to say he torched it--which is dumb because replacement costs more. Contact a member of the Ks Assn for Justice who handles "bad faith" claims --they give free consults.
Accident wasn't my fault. Someone backed out of off street parking spot and they hit me. I was already behind the person when they put the car in reverse.

technically, the charges can come through quite a while after an event, but practically, if you don't get a ticket within a day or two, or at most a week, you are not likely going to get one. From the facts you mentioned, it doesn't sound like you should get any ticket in any case.
I live in Kansas. Should I suspect future ramifications in the mail?

Yes, as sometimes it take 5 weeks to get test results back. Suggest you contact an attorney who handles DUI's in the county where you will be charged.
He hit someone but no one was hurt and the ticket just says not stopping at a stop sign

If he is going into the service (for real not a "I think I might" ) then cop may move it down to a non-moving violation.
Otherwise, he gets points, his insurance will go up.
Possible a judge could drop it but there was a crash and the judge & cop will be concerned that... View More

Depends on the light at the moment he clipped you.
If it was red, he was to stop.
A year ago I was in an accident. It occurred at a intersection while the light was yellow. I was driving straight through the intersection and a lady turned left in front of me. We ended up going to court and the judge ruled both of us not at fault. I paid my ticket and that was that. Now I am... View More

Anyone can say anything. If she turned left, unless it was on a turn arrow and you had the red, you have the right of way. If you were hurt contact a member of the Ks Assn for Justice--they give free consults.
You don't want to ignore a court summons even if you weren't at fault.... View More
am 20% at fault, which seems a little high as there was plenty of room for the vehicle to back up and not hit my car. Should I contest this amount?

You bet. Unfair insurance practice. They don't move, contact Attorney general's office and Insurance commissioners. Your car stopped. other car moving. Game over.
On Thanksgiving day, in the pouring rain, an individual put his truck in reverse and backed into my husband as he was leaving the JC Penny parking lot. When he realized what had happened, he admitted he backed into him because he did not see the vehicle, (saying it was small), provided my husband... View More

They claim that because they posted a sign, which I did not see, that says they are not responsible for theft or damage to a vehicle in their lot they have no responsibility to do anything about the damage. Is this true in Johnson County, Overland Park Kansas?
