Q: What legal recourse do I have under the lemon laws for MD?

I purchased a 2013 650I BMW from an Annapolis MD dealership in or around 7/2022 which unbeknownst to me was a lemon. To my surprise, I learned during a service call for an oil change in 6/2024 that the vehicle which has been driven minimally as a result of me working from home during the pandemic... View More

Q: Can I file a consumer complaint if a brand new car had problems

I purchased a new 2021 Jetta in April 2021. In September 2022 during regular oil change the dealer told me the rear brakes were down to a 1 which was really odd for a brand new car with less than 15000 miles.

They also said VW won't cover the repairs since it was just outside the... View More

Review your sales contract. It will determine whether you can return the car and any warranties that apply. Most used cars have at least a 30 day warranty if purchased from a dealership. Contact them immediately and insist that they fix the damage. Most used car sales contracts state that the... View More

Q: "The law does not stand anywhere." Is this a fact of legal theory, or just something with which to hit me on the head

Your statement: The Law does not stand anywhere. Et tu quo que.

Your view of the Law depends upon where you stand; and where you stand depends upon the Laws view of you.

The law’s view of condo governance is that the condo documents control, except where they don’t. There is no statute on BBQ on the balcony unless it violates fire code, but the condo association MIGHT be able to regulate it… if they did it correctly… which they often don’t.

You should seek counsel familiar with Maryland’s Lemon Law. It is tricky but I have found that once counsel gets involved, the buyer gets a response. Again there are certain procedural and timing requirements that competent counsel can assist you with.

If you were able to have it pass state inspection, and if you told him that it had been rebuilt, then you should be in the clear.

However a court may not have much sympathy for you if you didn't tell him about all the damage.
