Does this void your contract? Probably not. However, the reason for the error should be investigated. I suggest you file a complaint with the Michigan Attorney General. And also contact the S.O.S. and ask questions. Perhaps they can shed some light.

Q: I purchased a new car and its had a very high pitched squeak that has persisted since I recieved the car.

It has gotten worse since I have gotten it. I wouldn't be concerned if the dealer could diagnose the issue. I am concerned it may become an issue down the road. Do I have a case under Lemon Law.

Q: Is the owner of the dealership responsible for the seller's actions? If so, where could I find this law for court?

I recently bought a car from a used car dealership in MI that was greatly misrepresented. The seller was just a guy who the owner was allowing to sell cars out of his dealership, not an employee. After many issues, I sued the person and the dealership, and the seller has since fled the country. Is... View More

Do you have a judgment against the seller? If you do, you may be precluded from now going after the dealer because generally you need to bring in everyone you can when you first file an action. If you don't have a judgment, you will need to somehow legally tie the dealer to the seller.

Can you? Yes. Should you? No. You need to understand that major corporations like Ford have entire departments full of attorneys working for them, any of whom would have a field day with a pro se litigant. The first thing they will do is remove the case to the general civil docket because 1)... View More

Q: Is it the manufacturers fault or the dealerships fault? Also should I hire and attorney and if so which type?

A recall (ECU software update) that came with an emissions warranty came out in 2019. I tried to have the recall done in 2019, dealership said they couldn't do it due to modifications made to the vehicle. In 2021 I went back to have the recall completed with same "modifications"... View More

I suggest you hire a lawyer to address this matter. At the very least you should have an attorney send a demand letter to both the manufacturer and dealer.

Q: We bought custom furniture in April 2021. It was delivered October 19,2021. Within a week we notice a squeaky noise

Repair service came out and agreed there was a problem. Supposedly they order a part. Nothing has been done as of January 17, 2022. Can we demand a refund?

Likely depends on the purchase agreement, company policy, as well as the status of the part that was ordered. Demanding a refund and getting a refund are two different things, and being custom furniture, your question requires a much deeper than typical contract analysis to get a closer answer.... View More

Knowing the year/make/model of your vehicle would be helpful.

The first thing you should do is send a final repair letter. Immediately. A lawyer can do that for you. However, Michigan’s Lemon Law, like most other States, requires the consumer to provide the auto manufacturer with one...

Q: Hi, I just purchased a car from a private seller, they assured me there was no issues and I could bring it back.

I purchased a car from a private seller. He assured me there were no issues other than cosmetics, after driving it home I immediately informed him that the car ran rough, on the highway. He told me that if I found any issues, we could trade back the next day. I told him this is what I wanted. He... View More

A Michigan attorney could advise best, but your post remains open for two weeks. As a general matter, it could be a difficult situation - one party's word against another's, as the communications/agreements appear to have been verbal. One option could be to review the terms and conditions... View More

Interested in a particular vehicle at a used car lot but was told I will not be allowed to take the vehicle to another mechanic's location to have the mechanic inspect the vehicle. I need to know if this is legal in Michigan or not.

As always, you get what you pay for. Be sure to talk to a qualified attorney about your specific situation before choosing to rely on any information you get from internet discussion boards, such...

Q: I bought a new construction home in June. I've had nothing but problems. Is there a lemon law for homes?

Cracks in walls, cracks in foundation/basement, shoddy craftsmanship, cupboards falling off the walls, water heater leaks, A/C unit not working, basement flooding after the cracks had been "fixed" with caulk. Was given 1 year warranty and the house is falling apart around me.

There is not a 'lemon law' per se, however, there IS the possibility of proceeding against a builder's license IF ALL ELSE FAILS. (Note that caveat!)

You HAVE to give the builder the opportunity to repair issues, and provide appropriate notice before you can do anything...

Q: I was not disclosed of a vehicle purchase at a dealership that was a lemon?

Now my car is worth substantially less than what I paid for. Is it legal for a dealer to be dishonest about a vehicles past history?

There is no disclosure requirement in Michigan. Generally, the seller does not have to tell a prospective buyer about repair history. The main goal of a used car salesman is a to sell vehicles for substantially more than they are worth.
