Cost and can it be dismissed because of incorrect info on year of car

answered on Jun 26, 2022
No, they will simply amend the ticket to show the correct year.
The court said I had to pay it. However, a reputable business did the tint and when I got it tested by another business, it is indeed legal all the way around the car. How can I provide this to court after I've already had court? It seems asinine (and more like theft) to force someone to pay a... View More

Unfortunately, if you have already been found guilty, then you are precluded from being able to bring in new evidence that you could have gotten prior to your court date.
I came up on an accident as I was headed home from work. As I approached the scene I was flagged to come on by so I proceeded through. As I was passing through the apparent supervisor hollered at me to “slow down” at this point I was maybe doing 5-10 mph on an extremely narrow road. So I keep... View More

The issuance of a citation/ticket under these circumstances is most likely valid, however the ticket is simply an accusation that you committed an infraction-----based on your post, there are legal defenses available to you, as well as perhaps the less than common sense of the EMS people out there,... Got 2 tickets today for no license and not stopping at a stop sign. But the officer wrote on both tickets it's a 2023 the year of the car. But it's a 2002 model.

Unfortunately, with the way that traffic tickets work in Mississippi, the fact that the law enforcement officer wrote down the wrong year does not automatically lead to a dismissal, as it is considered a simple error.
I got 2 traffic ticket yesterday. Both of them got the year of the car 2023 but it's a 2002 model. Can I get both of the tickets dismissed by a judge because of that mistake?

The vehicle is swerving and its a two lane straight away ,I speed up just to pass and then return to the speed limit is this illegal?

answered on May 9, 2022
If you are travelling over the speed limit and you are pulled over for speeding, then it's a valid ticket. You have the right to contest the ticket and depending on the circumstances you might prevail. The best chance at prevailing would be if you had a traffic ticket attorney representing... View More

You will need to call either the Municipal Court or Justice Court listed on the bottom of the ticket and ask the Clerk’s office.
I got a possession of marijuana ticket and a no running lights ticket and the officer gave me someone else ticket can my tickets be thrown out

answered on Feb 6, 2022
Potentially; however, the question is really going to turn on whether the officer corrects the mistake and gives you the correct ticket at some point, which could include the day that you are supposed to be appear before the court.

Unfortunately, without more information, there is not enough information to go on. I would highly recommend that you reach out to a lawyer to go over the facts and circumstances of your case, so that you can determine what can be done.

What is your question? The excerpt does not mean that the ability to drive is a right. This part of the holding is referring to an individual’s right to operate a motor vehicle free from interference from law enforcement absent a good faith belief, or observation, of criminal conduct on the part... I have never received a ticket before, so drivers record is clean. I'm from Louisiana and received these tickets in Mississippi. But 2 tickets are not valid in my state of LA but is in MS. Understandable. But one of those tickets was no insurance, which I have but just didn't have the... View More

It sounds like you have 4 paper violations----if you can cure the paper violations and provide proof that you have them taken care of, then the prosecution is likely to provide you with an offer to resolve the matter, maybe even dropping them completely. The safer way to do this is to hire a MS... View More

It would severely weaken the prosecution's case; however, it does not necessarily make it go away. What ultimately happens depends on the facts and circumstances that occurred, as well as what is presented at trial.

It's not illegal simply to ask that it be removed. Sometimes, the trooper is willing to work with people, but it all depends on the trooper and the circumstances.

Long story short, the police officer can keep the traffic ticket in active status until the person ends up going to court, even if it is until May.
I was pulled over for speeding. I was going 45 in a 45mph zone. The officer claimed I was in a 35mph zone and wrote my ticket for 49mph in a 35mph zone. I pointed out to him that day before the ticket that I was not in a 35mph zone and he got an attitude. I didn’t argue but instead accepted the... View More

Assuming that the ticket has the location on it, as it should, one of the things that you can do is take a picture of the signs indicating what the speed limit is, and perhaps cross reference it with Google Maps.
Ticket has no name, address, vehicle info, court date, signature or anything. Officer said it was for expired tag. Is it valid at all?? What am I supposed to do with a blank ticket???

answered on Nov 24, 2021
If it is blank, then it does not have the legally required information on it to be considered a valid ticket. That being said, you may want to double check and see if there is a court date for your daughter, just in case the officer does submit something.
Need to know what are the options. Also charged with dui after making it to station they blowed him instead of when they stopped him.

answered on Nov 18, 2021
Likely it will not be dismissed, as those are minor details; however, they can certainly be used to show that the officer was not doing their job properly. From the looks of it, though, the major thing that you should be concerned about is the DUI, as the penalties on that are much harsher.

answered on Nov 18, 2021
Potentially yes. You will need to make sure that you show the court that your tag was not actually expired when you received the ticket.

answered on Nov 16, 2021
Yes, there are other ways for an officer to determine your speed.

No, however it could depending on whether the prosecution offers a plea.
