She has not done any of this and has me blocked from contacting her. How can I file a contempt of court

If it is a Nebraska child support order, then there must be a Nebraska court case that created the child support order. If you contact child support services, you can find out the Court Case number. The case number would also likely be on any invoice you receive for child support.

If it is a South Dakota case, the person inquiring needs to speak with an attorney licensed in South Dakota. If this was a Nebraska case, the party would likely be able to reopen enforcement of unpaid judgment established by a court order for child support.

If you already have a child support case through the courts that case needs to be listed/identified in the divorce filings so the Court is aware of it. Back child support continues to be due even after the child turns 19 years old. The back child support is owed to custodial parent, not the child. Thus, the back child support continues to be owed, but it is owed to the parent not the child.

You can file an action to ask the Court to establish paternity and child support. Alternatively, you can contact child support services and request the State file a paternity action now that you have contact information to attempt service on the father.

Q: I am being charged with a class 4 felony for back child support and now am being charged for 4 charges rather than one

Q: Do the courts in Nebraska only consider nights as days you have your child? I have him 2 nights but 3 days a week.

If that is the case the percentage of time I have him wouldn’t really be correct and I would have to pay more child support.

Per the Nebraska Child Support Guidelines, the Court looks at overnights when determining how many "days" a child is with each parent to determine whether to use the joint custody or sole custody calculation for child support purposes.
