You must appear in court to answer the petition. The fact that she is petitioning for custody does not mean that she will be given custody. Q: If a couple that is separated writes a parental agreement contract, can the cops get involved if one disobeys it?

Without going to court my ex and I would like something, such as a parental agreement stating who has the kids and when. If we make a contract ourselves and sign it, if one threatens to keep the kids can the police get involved? Will it hold up in court?

No, the cops won’t get involved unless there is a court order. What you have in mind has no legal effect. Better to go to court and get a custody order.

Custody can be determined in your divorce proceeding either by agreement or by trial. If you and your wife are unable to agree to a custody that you like, you would benefit from retaining an attorney if you hav not done so already.

No one should be forced to work for free, and that goes for any profession, including lawyers. Your attorney deserves to be paid and does not have to agree to any payment plan. If he or she does it is voluntary on them. Find a way to pay them or find a new attorney.

Unless the order states that the children cannot be removed from the country, state, area, etc., there is no prohibition against taking the children out of the country without the other parent's consent. It becomes a problem if the relocates the children to another country permanently.

Q: Does he get visitation both from 7:30am-4:30pm on Friday, and then also the holiday schedule 6pm to 1pm the next day?

I am the custodial parent to my son, and his father is non-custodial. He unofficially takes him every friday from 7:30am until 4:30pm. (This was verbally agreed on, but not filed in our court order). His father also gets visitation on December 23rd at 6pm until December 24th at 1pm.

For the visitation schedule to be enforceable, either you or the father would have to file a petition with Family Court and an order issued.

Non custodial parent has not made contact in a year. They have a history of disappearing for years at a time.

No. The mother's better course is to do nothing. If the father petitions, then the fights begin. The mother should not start a confrontation when one is not needed.
