Hi, I'm a stay at home mom to 4 kids including a breastfed infant. My husband works 12 hours a day and 3 days off, but is not present when home as he smokes weed outside for hours on end. Or he's asleep because of medical issues and can't be woken up. I have a support system and do... View More

You should talk privately with a divorce lawyer. Don't be afraid. From what you said, it is most likely that it is in the best interest of the children for them to be with you. A Guardian Ad Litem can be appointed who would probably say that the kids should not be with a pot head. He would... View More
He was awarded custody and lied about everything . He never took the kids to live with him. That was Feb 2020. I was ordered to pay support. I have the kids 90% of the time. I’m currently being treated for stage 2 breast cancer. I’m unable to get a job until I finish chemo and recover from... View More

Courts do not appoint attorneys for divorce cases -- that's only for criminal cases. The spouses get their own attorneys and pay for them. It is not required to have an attorney for a divorce, but it is recommended. Use the Find a Lawyer tab to contact some local attorneys and select one to... View More

But i cant prove she is abusive. Ever since she got custody of me at i think the age of 3, there has never been any love and its always been basically hell. Never trust people you meet on-line - even though they seem nice. Those kinds of things end up as tragedies on the news -- or else somebody disappears and is never heard from again. Talk to a teacher, school counselor, or other trusted adult about the situation at home and the people you met on... View More

Sounds like some entity is trying to collect support from him. You need to retain a local attorney to determine if the order is valid.
Please help... I just want to be able to live independently without him. I pay for food, drinking water, my phone, car, insurance, and college. Can he kick me out or are there any options I can use to benefit me. I’m struggling in this toxic household. I work so hard....

Yes, he can get you out. Parents do not have a duty of support when you reach age 18. If you do not have a written lease agreement, then the home's owner can give you written notice to vacate, and if you don't leave, can file an eviction. There currently is a CDC moratorium on... View More
The father pays child support but the court did not set a visitation schedule due to the mother not showing up for court. She will let him see the kids but only when she wants and she has to be there the whole time. He can't even take the kids out to the park or do anything with them. She only... View More

Because you are not married, yes, you have custody by law. Father can seek shared parenting, custody, and/or parenting time through the court. You will need to file for child support.
I have three children ages 12, 8, and 5. Current child support order. No court visitation schedule. Dad is harassing me. Threatening me. Do you really believe he will not bother you if you drop support? If so, and you want to do this, either you or he would have to file a motion to modify support. You can agree to do so, unless you are receiving government assistance.
We agreed in our dissolution, to no child support. She came to me shortly after that, and demanded I paid her. So I have been paying support, since then, though I was not ordered by any court to do so, so she wouldn’t move my child a long distance from me. Now she has brought up going through the... Yes, she can file to have a child support order issued. Even after a marriage terminates, the court retains jurisdiction to review child support issues until the child is 18 or graduates high school. Yes, you should file to modify parenting time. It would be best to have an attorney assist you in how best to present your arguments. You will probably want to ask the magistrate or judge to interview him on what time he’d like with you.
Will I need to be prepared to be questioned about this in court?

The domestic violence case is not relevant unless the father lost his job due to being jailed. If so, then you need to let the court know this was from an assault on you, the mother, and he needs to continue to support his children.
We share custody. Judge said I don't have to pay child support which is documented in the parenting agreement, which she won't sign. Without that signed agreement, she is looking to have custody changed to the standard of 1-day a week and every other weekend. When I have been present his... View More

If the parties are in agreement, direct pay can be written into the Decree. The specificity as to amount, due date, and length are essential terms. I suggest a lawyer to draft the appropriate language to consider other safeguards, but it is appropriate with the minimum terms.
We found out through 23nMe. They divorced when I was a baby. Very messy divorce. He didn’t pay much but only paid till I was 13 years old. I moved in with him from my mother’s due to abuse. Both parents abused me mentally and physically, as well as each other.

No. He waived his right to contest the child support order. The only way to waive the arrearage would be to have your mom agree to it, and even then she cannot waive any support owed to the state.
