If the mother and father are not married, and a court has not granted father parental rights or visitation, then the mother has sole legal custody and can prohibit contact with the father. Q: Not married but want to separate with one child.

Because you are not married, yes, you have custody by law. Father can seek shared parenting, custody, and/or parenting time through the court. You will need to file for child support.

Do you really believe he will not bother you if you drop support? If so, and you want to do this, either you or he would have to file a motion to modify support. You can agree to do so, unless you are receiving government assistance.

Yes, she can file to have a child support order issued. Even after a marriage terminates, the court retains jurisdiction to review child support issues until the child is 18 or graduates high school. Yes, you should file to modify parenting time. It would be best to have an attorney assist you in how best to present your arguments. You will probably want to ask the magistrate or judge to interview him on what time he’d like with you.

The domestic violence case is not relevant unless the father lost his job due to being jailed. If so, then you need to let the court know this was from an assault on you, the mother, and he needs to continue to support his children.

If the parties are in agreement, direct pay can be written into the Decree. The specificity as to amount, due date, and length are essential terms. I suggest a lawyer to draft the appropriate language to consider other safeguards, but it is appropriate with the minimum terms.

Q: At 36 yo, we found out my father is not my biological father. Can he go after my mom for the child support he paid?

We found out through 23nMe. They divorced when I was a baby. Very messy divorce. He didn’t pay much but only paid till I was 13 years old. I moved in with him from my mother’s due to abuse. Both parents abused me mentally and physically, as well as each other.

No. He waived his right to contest the child support order. The only way to waive the arrearage would be to have your mom agree to it, and even then she cannot waive any support owed to the state.

His support was raised . He has not had a modification in 5 years . He has missed parenting time on occasion and doesn’t pay half of the expenses previously agreed upon .
