Just as I was about to enter the rightmost lane, I was pulled over and given a summons for improper passing. I never... View More

If you had an emergency and you believe you did nothing wrong then plead not guilty and go to court and tell the prosecutor that and he'll probably schedule it for trial at which time you'll have the chance to explain the nature of your emergency. Good luck!

Maybe they can charge with negligent homicide?

If it renders you under the influence or in other words if it impairs you or has a deleterious effect on your driving then you may be subject to arrest and prosecutor for DUI.

It's not automatic unless you plead guilty or found guilty after a trial. If you fight the case and win then you won't lose your license or will lose it for less than the minimum of seven months and you may not have to have the interlock device bc it's mandatory for over .15 reading.
I would like to know if this is going to cause a fine and this is my first time? Or this can be a jail time? I am really afraid.

If your first time then very unlikely that you'll get jail but you should get a lawyer to help you avoid the criminal record.

It's hearsay whether signed or unsigned. Attorneys in criminal courts must confront witnesses and they can't confront a piece of paper.

Depends on your insurance policy. Most policies will say that they will deny it. However, in my experience most insurance companies don't strictly enforce this provision. You should make the claim and see what they say.

Your post is unusual and to the reader especially one trained in criminal defense it reads as if you created the danger yourself in order to relive the exercise maybe? And that you simply miss the action and are concerned that you are in trouble now. Otherwise why would this be posted in the... View More

I'm on probation and I don't think those charges should stand legally because of the good Samaritan Act. Or they searched without consent. Can my case be dismissed?

You have to get a lawyer to file a motion to suppress and to raise your defenses. An attorney can't answer yes or no in a vacuum. You have to give it a shot and your best chance is engaging services of an experienced attorney.

Worst that can happen is 30 days of jail for first dui offense and of course it depends on several factors such as accidents, bac reading etc... but truth be told I've never seen a Judge send anyone to jail for first dui offense however, they have the discretion so even if it's 99% that... It's doubtful that you'll get into criminal charges for this prank but if you do then it'll go to juvenile court and it won't have much of an impact on your life. I wouldn't lose sleep over this but don't let your behavior escalate.
