Q: I have a small business that is in the process of closing.I have a Work Comp Penalty that I am making monthly payments

The penalty is not right and I tried fighting the accusation. I lost. Once the business is closed, can they go after me personally for the payment? Do I legally have to continue to pay? Thank you.

If this is in relation to a stop work order then the Division can only go after assets related to the business and owned by the business, or corporation.

He should ask for proof of coverage and payment. That's a significant whack--20% of his pay.Not ususal. Does he get w-2 or other form at the end of the year?

If related they should be. If you don't have an attorney contact a member of the Fla. Assn for Justice who handles workers comp=-they give free consultations.

No, he can't sue his employer. He can, however, receive workers compensation. He should consult with an attorney who practices workers compensation law.

Check with an attorney specializing in workers comp. It is a close question, depending on such things as whether your issues were caused by a work-related injury. It could be, perhaps, that while workers comp. doesn't cover it the health care provider may be liable.

Yes. If he was injured on the job he is entitled to workers compensation. If he is no longer employed at that job he is generally entitled to unemployment insurance benefits.

But you should be aware that an employer cannot discharge an employee because he has filed a workers compensation...

Q: Can Workman's Comp stop or delay your payments in retaliation for you retaining a lawyer?

My employer let me go while out on Workman's Comp and I am still undergoing treatment. Since retaining a lawyer, my checks have come later and this one has not come at all...Is it legal for them to stop or delay payments because you have a lawyer?

No, the WC carrier cannot retaliate for your retaining a lawyer. But I suspect it's just a coincidence. Or perhaps the issuing of checks has been transferred to a different department. Ask your lawyer.

Q: Can I file for lost wages as I have received nothing since 2004 except to see a comp doc every month since 2002

I originally fell at my job 1996 and reinjured it in 2002 , Been seeing comp doc since then every month. However WC has not paid me for my lost wages since I was taken out of work in 2004 because of the injury. This is for NYS comp . I now live in Florida

Q: Can an employer in florida pay you only 80% of you salary while recovering from an injury non-work related

My fiance is not on workmans comp but his job is giving him a helper to lift beer and put it away, he is still driving the druck, taking the beer off the truck with a pallet jack, and checking it in. So since he has a helper they are docking his pay

Hello, a friend of mine dropped a heavy box on her foot at work and requested workmans comp from her employer 2 weeks after when a doctor told her she had a broken foot. Her employer denied her request, is this legal? If not, what does she have to do from here?
