Q: My ex filed for bankruptcy and was already $4,000 behind in child support. He now owes over $15,000. How can he not pay?

He does have custody of her now but why is the amount still growing and why isn't he forced to pay what he owed prior to bankruptcy?

You may want to consult with an attorney who can review your options and help you with the proper course of action. The arrears will never go away, so he will continue to owe them.

If you file your Answer and Counterclaim in person then you do not have to pay any fees. If you file your Answer and Counterclaim via PeachCourt or E-File Georgia you will have to pay processing fees once to use the portal and no additional fees after that.

child support arrears were included in a modification settlement agreement and included a payment plan toward the balance. Will the principal amount accrue interest if there is a payment agreement?

THAT WOULD DEPEND ON WHETHER THE AGREEMENT PROVIDED FOR INTEREST TO ACCRUE. HOPEFULLY, YOU USED AN ATTORNEY THROUGH THIS PROCESS SO THAT THE NECESSARY LANGUAGE FOR THIS WOULD BE INCLUDED IN THE AGREEMENT. IF SO, YOU SHOULD SPEAK WITH THE ATTORNEY WHO CAN REVIEW THE AGREEMENT WITH YOU TO DETERMINE... View More

If there is a current order of support which shows that your mother has custody, you will need to modify that order so that you have custody and are then entitled to receive the support.

If there is no court order, you have custody of your child. However, it seems that you have been sharing parenting time with his dad, which is a good thing. A court determines what's in the child's best interest regarding custody. If you have your son more now and the schedule is... View More

Q: In the state of Georgia, does the husband get better treatment if the wife files for divorce?

My estranged husband stated I should be the one to file divorce even though I didn't want a divorce, because if he files I'd be entitled to more support from him or something. Is this true?

It does not make a difference who files first in the divorce action, it does not mean one party will have preferential treatment over the other party.

Don't worry about the lawyer says. First, anything you add to the petition isn't considered evidence. In court, you present the evidence to the judge. But send clear copies of your evidence to the attorney ahead of time. Let the judge decide if your evidence is usable or not. But you... View More

If you think your child is in harm or danger, then you shouldn't be ok with joint custody. Presenting a custody case is more than just giving the judge a parenting plan, but more about proving why that is in your child's best interest. Speak to an attorney in your area about your options.

It's possible to subpeona bank records so you can track spending and income. There isn't an easy way to explain the process. You have to issues the subpoenas, give notice to the other side and also know how to get them into evidence.

You should probably hire an attorney to assist you.
