Q: Icharged with DUI 4th in ky, eligible for license in 5yrs.never get them. caught driving. What's the correct chg?

Charged with a DUI 4th could have got license back in five years however never did. Now it's six years later and I've been charged with driving on DUI suspended. Shouldn't it only be driving on suspended license? Or no license?

Q: Will KY find out about 2 dui's in MI? First was a fine, second is pending plea deal. This person also has a PI in KY

The second dui is aggravated as her BAC was >0.17, open container and her dui's were 18 days apart. Her judge runs a sober court, and was a prosecuting attorney as was her police officer. Most likely, yes. They usually run an NCIC check for nation wide criminal history or pending charges.

Q: How can arresting officers be held accountable in the state of KY?

My daughter called for help as the victim in a domestic violence situation and the responding officers ignored her statements and arrested her for DUI for sitting in a parked vehicle with engine running that "smelled strongly" of marijuana on their arrival

Q: I got a dui in ky offered them mt blood they couldnt get it. I told them i was onbmy methadone n smoked a blunt earlier

Under Kentucky law new felonies must run consecutive if picked up while on probation. His credit should only be applied to one case but ultimately it’s up to the calculations by the department of corrections after he is sentenced.

Q: Is two years and one month a harsh sentence for a dui, criminal mischief, wanton endangerment, fleeing and evading?

I went to rehab and haven’t been in trouble since it happened almost 2 years ago. This is a first offense. I already took a plea deal but feel that my lawyer did not do his job correctly.

You need to contact a Kentucky DUI attorney who can help evaluate your case. You may be able to plead guilty remotely using Zoom depending on the county, but a DUI remains on your record for 10 years. Most counties are requiring an in-person appearance for a trial now.

I Keep getting a different answer when I call Frankfort. I’ve done everything asked of me. I don’t think I should have to take DUI classes here in KY for a DUI in NC. Can you help me navigate this situation?

Get your proof of class completion in NC and deliver it to the DOT in KY. You do not have to take classes in Ky if you have completed them in NC.

Q: I plead guilty to a DUI in 2011... can I have it expunged now? or do I have to wait 10 years since the law changed?

Just curious because I believe the law was previously 5 years for KY and it changed in 2016 in the midst of me waiting 5 years.

You can expunge 10 years from the date of conviction.

You can unless your license is pretrial suspended, which they should have told you and take license if it is.
