Q: I just learned that 4 years ago, a serious speeding ticket was issued to me in SC....but my fin revs prove I was in TN??

I have no recollection of it, also, I ALWAYS pay promptly. $250/month has come off my credit card for my auto insurance since 9/2/2017...when I've always paid only $85. I believe this is a ticket error or traffic ticket fraud. Please advise! Thx.

You have not investigated this speeding ticket. Hire a competent attorney to check into it. But if SC does not send a release to TN Dept of Safety, you will probably have to pay it in full. Otherwise you will have to go hire a SC attorney, file a suit, and probably get a case of home cooking.

Going 74 in a 55, just over the border into TN where the limit changes from 70 (I believe) to 55. The officer said to just go to the website and pay, but there’s no amount listed on the ticket. When you pay that Speeding Citation, you will no longer have a perfect MVR. Call the General Sessions Court for the County you were apprehended in. Call the General Sessions Court Clerk in the County you were stopped in. If they know nothing about it, then again try the Department of Safety, Financial Responsibility Section. By then if you cannot find what Citation has to be paid in full, hire a competent attorney to run it down.

Whatever State that you got the Ticket in will have its laws control. That State may or may not have reciprocity with Georgia. The ticket you were given should contain the information about what is required of you. Most of the time, you simply pay the fine and all that happens is the ticket is also on your driving record. Being liable for tort damages is one thing. But the amount of damages is another. If you were sued then hire a competent attorney to represent you, to at least lessen the amount of damages. That judgment might follow you to Georgia.

I am unaware of any specific TN or Federal law that restricts TN law enforcement from using unmarked police cars.

Parking Tickets are not Moving Violations of the Rules of the Road. Usually City/County Ordinance or Code violations. That is non-criminal. You can go to Court and contest, or forget about it. Once the Citation becomes a Conviction, it is there forever. And if the Department of Safety says you have to pay it, then that is what you have to do for reinstatement. DOS issues the Licenses. The Fine is probably only $ 30. The Court Costs are alot more. As far as

I know there are no Misdemeanors that cost the Defendant less than

$ 150 in the State of Tennessee. You can ask the Clerk for an itemized list, but it will not do you any good.

You need to find out from the Department of Safety what you need to reinstate the license. Then spend the money and time to do it fast. You need to call the Court Clerk where your Citation has been issued from. They should be able to tell you what you have to do to have the Citation dismissed. The Traffic School usually issues Certificates of Completion that can be used anywhere. But call that Clerk.

Q: Is there a statute of limitations on traffic tickets?

My husband has tickets showing up on his license that are anywhere from 6 to 10 years old. And a majority of them arent moving violations, but his defense is suspended and remains on hold due to the tickets.

I recommend hiring a competent attorney in the County where most of the Citations were issued. He may be able to Move the Sessions Judge to dismiss some of them or at least execute some of the costs. Q: Could not find ins. card fast enough for officer and was given a ticket. Can I show proof of ins prior to court date?

This occurred in Shelby County, TN. I was insured at the time the ticket was written. Can I show proof now and not have to go to Court Date? If so, how? Also, is there a fine if you actually had insurance on date of citation?

You could hire an attorney who might work it out with the Prosecutor prior to Court. But from your on line location, I would go to Court with both an Insurance Card and the Declaration Sheet, along with some cash. Hire a competent attorney now. Ask the Department of Safety for a list of the problems which has suspended your License. Whether you like it or not, it will cost money and you cannot afford to get arrested all the time driving. Your personal situation is irrelevant.

An attorney would need a lot more facts - but generally one isn't strip searched for running a red light and having a suspended license. Consult local counsel to review the facts of the matter to determine what, if any, options you may have.
