You and your fiance would be well advised to get a prenup to protect her in child support proceedings. A subsequent child will not affect your child support

Permission to travel can either be voluntary or court ordered by a Judge. Call your custody lawyer.

Q: How can I stop paying child support arrears when I was never ordered to pay?

The kids were in foster care pre hurricane Katrina. They were visiting with the mother when hurricane Katrina struck Louisiana and fled with the kids to Texas without legal custody

Hr should only be paying ongoing child support if his daughter is disabled. He will be paying arrears until they are paid off. He needs to have a consultation with a family lawyer if he has any questions.

Q: My wife of 20 years left me. She hasn’t worked since 1997. Our 15yr old stayed with me. Can I collect child support?

She is living with her parents and they are paying for everything for her. We didn’t fight and there was no cheating. She left cause I am unemployed drawing unemployment and money is tight. She never offered to help and get a job.

Q: Can I legally ignore my emotionally abusive child’s father until child support and visitation is arranged in court?

I filed for child support yesterday. We are not together and were never married. He is claiming it is illegal for me to “keep his child away from him.”

Unless and until there is a judgment ordering visitation, it is not "illegal" to refuse to allow visitation.

Q: Can I file a petition for non payment to collect arrears?

Yes, it's called a Rule for Contempt, and you can ask the court for an award of attorney fees and court costs for the necessity of filing the rule, in addition to jail time and/or suspension of licenses issued by the state. Call a lawyer that handles divorce/family law matters to help you.

Q: Workers comp did not send my exhusbands settlement to the state child support office. Will my ex be liable for paying it

Workers comp already has the order to send money toward child support. However, they didn’t send anything from his settlement he was awarded. We go to court next month. Will my exhusband be liable for paying it back since he is in arrears of $8000 and is on the delinquent payers list?

You need to tell the state you are back together. But you may no longer qualify for Medicaid.

You do need an attorney for custody and visitation. The state does not support you on that.

Q: The child is now 17 if support is court ordered to me by LA can arrears go back to his date of birth?

My child is going off to college soon and I've never had his dad on child support. Once paternity is proven, can I ask the court for it now and have him pay from my son's date of birth til now? Can I get the back pay for that past 17 years?

No you can't go back further than the date on which you first filed for child support and in no case more than 10 years.

Q: I am a legal guardian of a 17 yr Old almost 18.Mother is deceased for 9 yrs . Father is in arrears in child support.

Can the father still be held accountable to pay back child support filed by her mother when living and also filed for by her first legal guardian thru the District Attorneys office . He has eluded working for a paycheck,works for cash , he has eluded filing income tax due to previous garnishment.

Ask the the D.A. to get aN executory judgment. Then you can get the Judgment renewed every 10 yrs.

Q: I just put in my child support application with CSE. The father is unaware of this. What happens next?

Will he be served or just sent something in the mail that will go unnoticed since he does not regularly check his mail.

First CSE will determine if they will take your caseND asign you to a case worker. Then he will get a letter. Then they will file suit and in about 3 months you will have a court date.
