You can file for a divorce and if it is in the best interest if the children, you could ask for custody.

Q: DHS is telling me my child's support will be figured on an average of my income and the other custodial parent's???????

My ex-husband had another child and has since divorced again. Why would his ex wife's income be relevant to the appropriate support my child should receive? Is this a state law on how to calculate child support in Oklahoma?

The income of his ex wife is not used to calculate support. However, if he pays support in another case that can be a factor. Do not attempt to represent yourself. Hire an attorney asap!

Q: Can I make my spouse sell a residence listed in both our names in a divorce?

My husband is telling me that since his name is on the title to the lake house, that I can't make him sell. Is that true?

Q: Grandmother left house on 5 acres in OK to me and wife as joint tenants shortly after our marriage. we are divorcing

Q: I have been stuck "waiting" on DHS to approve terms in my divorce. It's been 4 months. What can I do?

My divorce has taken 2+ years, mostly due to slow system or overly busy lawyer. I am very tired of waiting and paying so much. My husband and I totally agree to all terms, is there something we can do to move it to final decision? We both want to move on from this.

Q: I'm leaving my husband. Can I be taken off his insurance?

I don't want to be on his insurance, if I'm the one leaving I shouldn't be his responsibility, and the insurance company is saying legally he can't take me off. Which is bullshit, it's his money why the hell cant he decide to stop paying them?

Q: During my marriage we purchased a home The home is not n my name n anyway and forclosing will i be stuck with half debt?

I havent lived in the home since 2013. I have been a homemaker and my x makes about 60k a year. I also have our child, student loans, and the car debt. Im trying to get back on my feet .

Q: Does my Indian card cover my obligation to carry medical insurance on the kids according to the divorce decree?

My divorce decree states I have to carry health insurance on the kids but we all have Indian cards and can get free healthcare.

Generally tribal health care meets the requirement, if the children live near a clinic where services are provided.

Q: When adding the VIN number to a divorce decree where they were left off in error what is necessary?

An attorney Filed a Order Nunc Pro Tunc which did not list the VIN numbers after over a month we were able to get Title through Title Clerk after not hearing anymore from attorney after filing this paper with Court Clerk

The Nunc Pro Tunc is the way to get the decree amended. But since you have the title, is it necessary?

Sorry, but adultery is still a felony in Oklahoma, punishable by up to a $500 fine and/or 5 years. See 21 OK Statutes § 871. Most District Attorneys are not interested in prosecuting these cases however. They're already overloaded with more serious crimes.

You should consult an experienced Family Law Attorney, in your area, for help with this problem ASAP. Many will work on payment plans. You can call the Oklahoma Bar Association in Oklahoma City for help finding a lawyer. Don't delay anymore.
