Q: I was called by a police officer and told that he didn’t want to put out a warrant but was only investigating.

Gave me the number of a “victims” dad to call and work things out. I feel like I’m being scammed

Hire a competent attorney to negotiate any prospective restitution to victims. Talking to victims directly is always bad, and make a bad situation much worse.

Q: If a search warrant's area for particularity refers to "Attachments A and B" but neither accompany it, is it valid?

When questioned regarding what the agents were looking for, all I was told is "evidence of crimes" and "we can take anything relating to our investigation--papers, computers, phones, even the house, your passports, and bank accounts if we want."

Q: Can my title 40 be used on a felony charge that I was never convicted of?

I was charged with aggravated assault but the case got dismissed in court. I believe the DA used my title 40 to erase the charge from my record even though I wasn’t convicted.

What is your question? You do not have a "title 40". That comprises hundreds of Statutes. Hopefully your charge was actually dismissed, which allowed you to expunge the records. It is not automatic, and it can be extremely difficult with lesser included offenses, etc. Hire a... View More

Q: I was arrested for accessory after the fact but can I be charged with it when I had no knowledge he resisted arrest

Or stole a truck when he came from a different county and picked me up he told me the vehicle was loaned to him and that he came to check on me bc I had no contact with him for two weeks prior to him showing up

You can still be charged but it may be hard for them to prove.

Q: Can i be charged for posession of drug when nothing was on me or in my stuff and i was in someone elses car?

I was in someone elses car and they pulled us over for having cross tags and then he gets arrested for driving on suspended and they decided to search the vehicle. Nothing was found on me or in my things but i got charged with the drugs and parafanelia and he didnt.

Those type of drug charges happen alot. Hopefully you can subpoena the driver to the Preliminary Hearing and have him admit to crime or not talk. Hire a competent attorney now, and do not talk to driver.

Q: I'm trying to find info on a T. C. A. Code 40-25-202 and am having no luck with Google. Any ideas or advice will help.

It varies from jurisdiction to jurisdiction. First, I would read your probation agreement, and see what it says. Ultimately it is up to the judge. Courts treat Violation of Probation seriously, so I would definitely retain a local criminal defense attorney.

Felonies are all car accident related one is aggravate assault, and the other is vehicular homicide.

I worked for the State of Colorado for 27 years. I’ve never had any further legal issues or arrests. I now live in Tennessee. The arrest was in Colorado.

mr. kent thomas jones ; nothing happened. she hangs out with them sometimes, one of the girls mothers are saying she's a pedo and that she's going to call the cops. nothing sexual, nothing in that nature, cause she knows she can and will be charged.

There is no crime involved with adults associating with minors, so long as nothing criminal occurs like threats, abuse, sexual acts, etc.
