It is not a crime. No points can be added to your MVR. But you can be sued for the debt.

Q: These charges have caused serious harm to my reputation and has costed me many job opportunities. Can I fight this?

2 years ago I was followed for 15m by a cop for no reason. I was pulled over after hitting the line on the side of road. It was night and I couldn’t tell it was a cop. Him following me for that amount of time was making me nervous so every turn I took he took and as I looked in my rear view to... View More

Go to the Court Clerk and get a copy of the Citation. If dismissed, then it can be expunged. If a conviction, only a few crimes can be expunged. Most convictions are permanent on your record. Take the Citation to an attorney for his opinion.

Q: In Tennessee are you required to give your SSN in order to receive a traffic citation?

I had an officer demand mine for the ticket and threaten to detain me and impound my car if I didn’t give it. I’ve been driving over 30 years and this was the first time I’d ever had an officer even request it, let alone threaten to cuff me and put me in his car. Then when he gave me the... View More

Whether to cite or arrest you is the LEO's discretion. So if you do not cooperate, he may arrest you. The SSN is available from the Department of Safety. Hire an attorney to represent you as you have already made the cop mad.

LEO's estimate by "pacing" all the time. You can question him in Court, but it is best to try to get some kind of diversion, leading to dismissal.

Q: I got a ticket back in 2020 for speeding, I was just curious when it comes off my record or if points fall off?

I plead guilty because at the time they didn’t offer traffic school, and it’s been 3 years later and it still shows on my record. I’m an electrician and didn’t know when they would fall off my license that way I can drive a company vehicle.

It should not be on your MVR for the DOS which is for the last 12 months. But it is still a conviction which will be on your NCIC check forever.

No, but go to Court with cash. There may be some Diversion available from the Judge, or even a reduced speed violation, as that 23 over will add points at least to a TNDL.

Q: I asked a few days ago about 2 speeding tickets I got. One going 37 over and 1 40 over.

Is it better to just pay them online? I had points on my record prior to this so it will probably end up getting suspended anyway. So don’t know if I should even go to court or just pay online

Absolutely hire an attorney to represent you on both Citations. Once the TNDL is Suspended, you will be going to jail all the time. Do not pay by mail as it will be an irreversible mistake.

He was driving behind me for a little until he pulled the person beside me over. So is there a chance he could’ve got my license plate? So should I expect something in the mail

Q: I had a speeding violation back in 2016 and was driving without my insurance card. I never reported my insurance.

It is now 2022 and when I call to obtain information about this case they tell me I have to come in for court to resolve. What is the likely hood of me going to jail or paying a fine? I need my license but I live in TN and have to go to Kentucky courts.
