If a LEO observed a Rule of the Road violation, he has a 1 year SOL to initiate the charge. So you may or may not get charged.
What is the state law for this violation. I have no prior vehicle violations of any type. I was given a citation, and the citation doesn't have any fine amount written on it.

There can be several offenses, not all of which are Rule Of The Road violations. Were you cited or arrested? If charged, you definitely want to got to Court. At worst it would be a conviction and costs. But you might receive some type of diversion, or some charges dismissed. You may receive... View More
Tag was in rear window was this a lawful stop
answered on Jun 14, 2023
Probably not. A good Motion To Suppress Evidence would need to be made. Hire a n attorney.

You will want to comply with LEO's request for whatever documents he asks for. If he does not ask for an item, then do not give it to him. Compliance with reasonable and lawful demands of LEOs at traffic stops helps alot with not being charged. Have vehicle documents ready to present to... View More
I greatly appreciate your time and any help concerning this situation. Recently i was travelling on a tn county rd with double yellow lines. I was approaching a slow moving farm tractor (travelling less than 25 mph) , i began to slow but had sufficent sight to know there were no on coming hazards,... View More

A Tennessee attorney could advise best, but your question remains open for two weeks. I hope you're okay after three vehicle flips. In most jurisdictions, you can't cross a double yellow line to pass. There are limited exceptions for turning into lots or streets. But that's only a... View More
If another driver has falsely accused us of being active shooters can we Sue that driver?

You have to file a lawsuit and demand Discovery.
The driver's ball hitch hit our front tag, no damage. Driver continued on. We went to the ATM & are surrounded by approx 5 officers pointing guns at our heads. I got 2 tickets, 1 for leaving the scene & tailgating. We were STOPPED. WE WERE HIT. We were at our bank's drive-thru... View More

Since no arrest, only a short stop and detainment, damages are minimal. The Tickets(Citations) must be dismissed by the Court. So you need an attorney to go to Court on the Rule Of The Road Violations, and an attorney that knows GTLA law so a Federal Civil Rights Suit can be brought, or at... View More

Charges for parking occur everywhere in TN, handicapped or not.
I got the ticket when the courts were shut down bc of COVID. When they resumed I missed the court date bc I actually had COVID. I had forgotten all about it until now. So, I just want to know what the best way to clear this up. Any advice you can offer would be greatly appreciated. Thank you

No the FTA is a separate crime charge. Hire an attorney to take you to Court off the Docket and clear this up, especially since you have already pled guilty and paid the Court.
I called TN drivers license and they gave me a claim number

Hire an attorney to take you to Court off the Docket. Have cash ready to pay it off in full. It might get dismissed.
So, someone I know got a speeding violation back in 2021 that required a court appearance. However, shortly after receiving the violation, they were incarcerated and put in prison for two years. Because of this, they were unable to attend their court date. Now, the day they were supposed to be... View More

I agree with attorney Avery. Part of hiring an attorney would be for the attorney to get the client's outstanding bench warrant resolved so that the holds on the defendant are lifted-----whether this means getting the defendant transferred to that court to answer the bench warrant or perhaps... Hire an attorney to represent you. Conviction will mean 6 points against your MVR, and you are only allowed 11. It is very easy to get caught again within 1 year. Speeding will usually mean less points and there are numerous possible pleas. Once you lose the TNDL, it will be bad. Some type of... View More

Parking Citations are not usually Rule Of The Road Violations, but ordinance/code violations. But they can be criminal. Either ask your lawyer about them or do nothing else to get in trouble.

It is not a crime. No points can be added to your MVR. But you can be sued for the debt.
2 years ago I was followed for 15m by a cop for no reason. I was pulled over after hitting the line on the side of road. It was night and I couldn’t tell it was a cop. Him following me for that amount of time was making me nervous so every turn I took he took and as I looked in my rear view to... View More

Go to the Court Clerk and get a copy of the Citation. If dismissed, then it can be expunged. If a conviction, only a few crimes can be expunged. Most convictions are permanent on your record. Take the Citation to an attorney for his opinion.
I had an officer demand mine for the ticket and threaten to detain me and impound my car if I didn’t give it. I’ve been driving over 30 years and this was the first time I’d ever had an officer even request it, let alone threaten to cuff me and put me in his car. Then when he gave me the... View More

Whether to cite or arrest you is the LEO's discretion. So if you do not cooperate, he may arrest you. The SSN is available from the Department of Safety. Hire an attorney to represent you as you have already made the cop mad.

It is not legal for law enforcement to coerce or threaten someone to provide information or act as an informant in exchange for leniency in their own criminal case. This is a violation of the individual's rights and can lead to further legal consequences for the officer.

LEO's estimate by "pacing" all the time. You can question him in Court, but it is best to try to get some kind of diversion, leading to dismissal.
