You should notify your homeowner's insurance as soon as possible. It is not up to you to determine whether it is a valid claim. Your insurance company will ask for your statement. Many times claims are denied by an insurance company if they believe their insured is not at fault.

Q: My daughter's dog was attacked by another person's dog.

The home where the attack took place is neither one's primary residence as they were both guests.

The other dog attacked mu daughter's dog without provocation.

You clearly have a hurt; but a legal case I don't see as the law doesn't generally value pets very highly and the SPCA isn't held liable if they get a signature from the wrong person. However just to be sure, why not contact a member of the Texas Trial Lawyers Assn--they give free consults.

She was not aggressive during the transaction of taking her and isn't an aggressive dog in general there was no police report. Just a report from dog catcher

Generally no. Emotional distress isn't favored in law. Best you can do is claim for vet bill, any future medical care they will need, perhaps return of some of the pet sitting fees. Contact a Texas animal rights attorney but I believe that is all you can get.
