Q: Is a car in the county impound considered "free game" after 30 days, considering cars marked AV roadside, are?

My van has been stuck in the county impound since I have no paperwork for it. I've been homeless since and would like it back. They won't be having auctions for awhile but its been 30 days already.

Usually they are infractions, unless it is a DUI or a misdemeanor. I really cannot say without knowing what kind of... View More

I recommend that you hire a competent attorney, or, if financial circumstances do not permit that, to apply for the services of a public defender. Depending on how you are charged, this is a matter which could result in the potential for jail time under these facts, possibly up to 10 days! While... View More

When you go to court, be prepared to show the prosecutor proof that your vehicle was insured on the day in question. The charge should be dismissed on proof shown.

A Hawaii attorney should advise you here, but your post remains open for two weeks, and it's likely that time is of the essence in what you need to do. Some states treat driving without a valid license as a misdemeanor - only a Hawaii attorney could advise there. But at least find out the... View More

Very definitely. Look for an attorney who handles traffic citations. If the crash wasn't your fault you have a claim for your injuries and should contact a member of the Hawaii Trial Lawyers Association--they give free consults.

Q: Someone is accusing me and my fiancé of crashing into their car. We weren't there and they have no actual proof.

They are posting it everywhere on Facebook and getting people to attack us. The person who crashed into their parked car left a note and the number isn't my fiancé but somehow brought them to his Facebook account. What should we do?

Notify your insuance to be on the safe side. Have an attorney draft a cease and desist letter. They can also give you a couple of short sentences you can respond to. If they aren't getting a rise out of you, sooner or later they will find something else.
