My understanding of Tennessee law is child support cannot be ordered while parties are married unless there is a hearing where the Judge orders that in a divorce proceeding. He will have to file a Motion with the Child Support Court. It is not automatic.

Yes, the full amount in arrears can be attached/levied by the Department of Human Services.

Yes. Income from both parents is calculated pursuant to the guidelines.

Child Support is possible, especially in the future when he obtains the age of majority. But you have committed a crime here called Statutory Rape.. Be very careful about complaining at this time.

No, the child support office will not be interested in attempting to sort out the payment of expenses. I recommend you consult with an attorney. You signed the contract indicating you have signed under duress. The other side may not "honor the contract" with the additional notation as duress can be used as a defense to the validity of a contract.

If your child support is paid through the state of Tennessee, then it is very likely his stimulus check will be intercepted. If the child support is from a divorce and it is paid directly to you his check may not be intercepted.

Q: Paying support for years w/o a court order just by verbal agreement with other parent.

I have paid support on my child for 10 years with no C.O. Other parent is denying visitation now. If I take other parent to court and they find my support order should be more will I be held in arrears even though other parent never filed motion for child support in 10 years.

As long as she is asking for child support that is only his child and not all three, then that is legal. Reprehensible, but not illegal. Now, if she asked him for child support for a child that is not his through the courts, that would not be legal.
