Q: Should I go give a statement if I'm being accused of a crime

I'm being accused if a crime no one has contacted me I have been calling around to different precincts they are telling me to wait till someone contact me ,and now one detective tells me I should come in and give a statement

You should never give any statements to police without an attorney present. Everything you say will be used against you in criminal court and your own statements against your own interests are most damning evidence that the state can present.

Depends on the weapon but if it's a gun then that's Graves Act case which means mandatory jail so unless he can get the search suppressed the best he can hope for is a three years with one year parole eligible. This means that it's a five year prison sentence but you'll be eligible for parole after one year in prison.

Q: Reckless Driving Speeding over 80 - traveling 85 MPH in a 70 Zone ?

I was traveling through Virginia from New Jersey on my way to North Carolina. I was pulled over in Emporia, Virginia on I-95. My violation is a 46.2-862 which I was speeding 85 MPH in a 70 MPH speed limit Zone. The court date is set on August 1st 2018.

Yes it's a felony and an official misconduct charge to boot. If they charge him with that he'll have to forfeit his career. Better get a lawyer and soon.

Depends on the underlying charge for the domestic violence, is it stalking assault harassment etc..? All carry possibility of jail but some more serious than others.

Some disorderly persons statutes like drug offenses or driving under influence with kids in car carry suspensions, but DP's like assault and theft or shoplifting does not. It depends on the statute. You can be detained if there's probable cause of criminal activity. So if there's marijuana in the car for example that's enough for them to arrest you even though it's not on you or next to you. In court you may get it dismissed but they'll have the PC to detain you.

You can plead not guilty and take statute from online to court and show prosecutor and ask him to agree that the officer made a mistake so that he may dismiss the case. I don't know this statute but 39:3-10b is unlicensed driver which if you read the statute online carries six months preclusion from obtaining a license once you become eligible to be licensed and up to sixty days in jail.

First you say it happened in 10 years and then you say 11 so you're probably counting from conviction date but you need to count from violations dates. Q: For criminal drug related fines over $2,000, can the court take money from your bank account?

A payment plan was never set up. The bank account was just made, the money in the account is for emergencies for our newborn and is from working under the table so there are no pay stubs or record of where the money came from.

There are procedures in place for this and you will get notices if they do but generally courts don't do that, they just enter warrants for your arrest and then charge you extra for contempt when you appear in front of them.

Just pay it. Not allowed? Call court tell em you're from colorado and you'll plead guilty by mail and to send you the forms for you to sign and mail back with the check. No other option such as fighting the ticket or hiring a lawyer considering you're from out of state is worth the expense.
