Q: Stepmother passed away am I entitled to anything from the estate ?

My father passed away about 12 years previous and I only received 3k from a 500k estate.

If she had a will, it goes according to the will.

If not, it goes to her heirs which would not include you unless you were adopted by her.

A long shot is that the father had a written agreement with her that she would leave something to you.

Well i needed a DNA test done do i went through the courts which created a child support case when the results came back i dropped the case but now I'm wondering can i put it back up or not

You need to file a Petition for Parentage so as to officially establish him as the father and have the court order him to pay child support.

To protect yourself, you need a new Parenting Plan signed by the judge.

The procedure is to file a Rule to Show Cause why he should not be held in contempt and punished by the court.

Same as if he didn't pay child support.

Back child support can be collected until it is all paid no matter the age.

Q: I am named beneficiary in my mothers will but it does not state what investments or insurance she had

there were no papers, or statements that had information on insurance or investments except for an IRA.

Most wills don't list insurance and investment information.

It is the job of the Executor to find out.

A starting point is the previous tax return which has a lot of information on it and bank account registers which show who was being paid.

His heirs inherit.

The ex-wife has no rights unless there are left over issues from the divorce.

The existing court orders stay in effect until they are changed.

He will have to go to court to terminate support and to collect from you.

Either party can petition the court for post secondary support.

The Secretary of State decides who drives. Not the courts or anyone else.

If you get suspended, you are suspended until they send you a letter saying your are reinstated.

Usually child support is based on court orders.

If the child is of age and there is no current support and all prior amounts have been paid there should be nothing further to do.

Obviously, this needs to be checked to make sure everything is correct.

Q: Can I get residency of my 13 yo due to mom not being able to help him with hw & he got convicted by juvenile court?

his mom has said she is not able to understand the homework but also she just doesn't make him do it. Also, he was convicted by a juvenile court this past year for criminal trespassing while under his mother's supervision. She knew he was trespassing in this building and even encouraged it.

You say you both had lawyers who didn't show up for trial.

Had you two reconciled.

Anyway, why not ask your lawyer what the status is because they may still be stuck on the case.

Minimum fine is a set amount.

Court supervision costs more but it stays off the record as a conviction.

Q: Do I need to file a quit claim deed if my deceased partner owned our house with me with right of survivorship?

The house is located in Will County, Illinois, and is owned as joint tenancy with right of survivorship. There is a death certificate issued on my partner. This was not a marriage relationship.

The reason for joint tenancy is to have the survivor be sole owner upon death.

If you sell or refinance you may be required to prove death with the death certificate.

Q: Can I find out if my wife is receiving child support from her ex still but not putting it into our account?

If you are supporting her kids you have every right to know if she is receiving money for the kids.

If she is not receiving child support, then she needs to go after the ex to collect it.
