Q: I got hurt at work and went to file a claim for workrs' comp. In the interim, I ended up getting convicted of another

crime (fraud). Does this mean I'm not longer eligible for workers' comp benefits?

It will not affect your eligibility for benefits (except while you are incarcerated) but if the claim is contested by your employer, the conviction can be used to impeach your credibility when you testify.

You can use your insurance and allow them to recover their payment and your deductible in arbitration with the Commonwealth.

Q: Being sued

I was in an accident in December of last year which caused damage to my car and the other parties car. When we went to court the charge was dismissed. Now the other party is trying to sue me for $25,000. Is that possible if so does she have a case?

If you were charged with a traffic offense, it makes no difference in the civil action whether that charge was dismissed or not.

If you are being sued, notify your insurance carrier and they will provide you a defense.

Are they liable for me slipping and falling? They had to now it was wet substance on floor, because they didn't they wouldn't had put wet floor signs after it happened

They obviously knew it was wet afterwards because you fell on it. It does not logically follow that they knew until after. I assume you reported it to them. Putting signs up afterwards was necessary to prevent any additional falls and does not in any way prove negligence.

If you filed a claim at the time of injury and are under an award for lifetime medical benefits, contact your case manager. If you are not under an award, the statute of limitations will most likely bar a claim.

Because you were uninsured, the claim would have been paid by the other driver's uninsured motorist coverage with GEICO. They now have the right to pursue you through subrogation for what they had to pay.

Q: I was at work and stepped off a transfer cart that was about 3 or 4 inches higher then the floor and my foot gave out.

A bone in the foot broke. Nothing hit it, no tripping and worker comp is not covering it.

It depends on whar the employer is willing to offer, how much in benefits they have exposure for, your TTD rate, severity of the injury, and likelihood of prevailing at the hearing, among other factors. The statute of limitations to file a claim is two years. You should have filed within that time. Your claim is most likely barred.

There are some limited exceptions but you would need to consult directly with an attorney to see if they might apply.

You cannot sue the employer but you would be entitled to an award for medical expenses and for the scar through worker's comp. Get your medical records together and consult with an attorney.
