So here is the story:
I’m a U.S. citizen, and my wife is a Canadian and Green Card holder. I have two kids, both of whom are American-Canadian. However, my wife said she wanted to go to Canada to visit her parents, and she asked me to sign a travel consent form so she could travel with... View More

You need to hire a divorce immediately and file for divorce. If they lived in Georgia the past 6 months, that is the home state and she could be ordered to bring them back.
This was for school matters with our child. The lawyer performed only one or two actions, for which they billed against the retainer. We haven't needed representation since, but left the retainer in place. There has been no correspondence either way. Just remembered the retainer exists. The... View More

That is an unusually long time to wait to see if you are owed money back. I'd suggest reaching out to them first. They may not have records that go back that far, so you may have to let it go.
I hired a divorce law firm in February and paid the 9k retainer. Just got notification they are withdrawing 0 warning. They scheduled two court hearings and took my evidence. I spoke with them 3 times and just got a notification from the court they are withdrawing representation because “it’s... View More

This doesn't sound like malpractice. Malpractice is a breach of an ethical duty. If you were billed hourly, a retainer is not the full payment and you have to keep paying the bills in order for the attorneys to stay on the case. Attorneys are allowed to withdraw from a case for pretty much... View More

He hasn’t paid since December. I went to the courthouse to file a contempt and was referred to my attorney because the judge hasn’t signed the divorce papers and it has been over a year. He paid via Zelle so I am due 4 payments on the 15th. What do I do?

He can't be in contempt if the divorce order wasn't signed. You need to co tact an attorney to finalize the divorce.
I dated a girl 3 years ago. We broke up and 6 months later she said she was pregnant with my child. She cut off communication and I never met or saw the child. You can't force a DNA test unless and until you file for legitimation. Once there is a DNA test ordered and you are the father, the court will address parenting time and child support.
He has no contact with the children in a few years now, he doesn't support them at all. He never calls it texts or writes them. He doesn't buy them things on birthdays or holidays. They are now teenagers 15&13. They don't even know him other than when they were younger. I have... View More

You can object to the legitimation. If he has abandoned his opportunity interest in ceing a parent, the judge can deny the legitimation. You are going to want to hire an attorney for this.
FL to serve the Summons and Petition?
answered on Apr 8, 2023
The first answer is not correct. You can serve per Georgia law. You have to use someone on Fulton's process server list who is willing to go serve in Florida, or you have to use the sheriff in Florida, or file a motion to have a process server in Florida appointed. That requires a motion and... View More
My husband and I are separated. I do not want a divorce but he is making really foolish financial decisions. Is there any way to protect my kids and me from his reckless spending and accumulating debt without filing for divorce?
answered on Apr 7, 2023
No, there is not. Courts do not interfere in financial matters in a marriage unless and until that divorce or separation is filed.

I didn't word My question clearly enough. Physical custody was obtained through the court system. There isn't a way to answer your question. It's too specific and an attorney would have to review the court orders as well as all payments made in order to advise you if you are correct or not. Given the small amount, you'd pay a lawyer much more to figure it out, it may make sense... View More
No children under 18, prior physical abuse, current verbal, financial and mental abuse. Can I leave without a document in place to another state and file for divorce there after establishing residency?
answered on Mar 27, 2023
You can move wherever you want. However, your husband may choose to file in Georgia and the case can proceed here. Each state has different residency requirements, so if he doesn't file, you need to contact an attorney in your new state.

No. You have no legal relationship with your birth mother. So she doesn't qualify as a grandparent to try to get grandparent's rights, and she wouldn't meet those standards anyway. So it's a definite no. You can exclude her if you wish.

You cannot remove someone from a deed unilaterally. Even if you have a restraining order. You will need to contact a civil attorney to resolve the issue. Your son has interest in the house.
